Legal Insurrection by Mary Chastain Tuesday, January 23, 2024

“We remain absolute in our actions to secure our border, preserve the rule of the law, and protect the sovereignty of our State.”

The Texas Military Department will not allow the border patrol to enter Shelby Park in Eagle Pass to cut the razor wire on the border.

The state took over Shelby Park, a public park on the Rio Grande, due to the lack of federal security on our border.

The Supreme Court decided 5-4 to vacate the injunction that prevented the agents from cutting the wire installed by Texas.

Texas took action because President Joe Biden’s administration hasn’t done anything to secure the border.

NEW: Texas Military doubling down by installing more razor wire and anti-climb fencing in Shelby Park. This coming after  SCOTUS ruling that allows border patrol agents to cut through the razor wire.

Texas officials have seized control of Shelby Park - we have not seen BP agents try to come in and cut the wire

Biden administration demands that the Texas attorney general give Border Patrol access to a park taken over by Texas

NBC News by Julia Ainsley 1/23/24

Earlier this month Texas Gov. Greg Abbott blocked federal agents from Shelby Park, a city park on the Rio Grande riverfront in Eagle Pass.

The Biden administration has demanded that Texas Attorney General Ken Paxton give federal border agents full access to a riverfront park in the border town of Eagle Pass, where state law enforcement officers have been arresting migrants who cross into the U.S., according to a copy of a letter obtained by NBC News.

In the letter, sent Tuesday, the chief lawyer for the Department of Homeland Security asked Paxton to clarify which parts of 47-acre Shelby Park remain accessible or inaccessible to the Border Patrol by Friday.

“The State alleged that Shelby Park is open to the public, but we do not believe this statement is accurate,” said the letter from DHS general counsel Jonathan Mayer. “To our knowledge, Texas has only permitted access to Shelby Park by allowing public entry for a memorial, the media, and the use of the golf course adjacent to Shelby Park, all while continuing to restrict U.S. Border Patrol’s access to the park. Please clarify the scope of access Texas permits to the public.”
