HARNEY COUNTY, Ore. -- A formal ruling by Harney County Circuit Court includes a permanent injunction today against Oregon gun control policy, Measure 114, to prevent it from taking effect.
Harney County Circuit Court Judge Robert Raschio entered the "General Judgment" this week, added to the case record yesterday in Joseph Arnold, Cliff Asmussen, Gun Owners of America, Inc., Gun Owners Foundation vs Ellen Rosenblum, Tina Kotek, Casey Codding. Kotek is Oregon's sitting Governor, replacing former Oregon Governor Kate Brown who was an original case defendant. Codding is superintendent of Oregon State Police, and Rosenblum is Oregon's Attorney General.
Judge Raschio's 49-page judgment presents the Court's findings for various points argued in the case, after ruling at the outset:
"... IT IS HEREBY DECLARED that Ballot Measure 114 is facially unconstitutional in all of its applications under Oregon Constitution, Article l, section 27; and IT IS HEREBY ORDERED that Defendants and Defendants' Agents are permanently enjoined from enforcing all provisions of Ballot Measure 14."
