President Trump's effort to exclude illegal aliens from being considered for purposes of congressional apportionment was stymied by the courts.

Opponents of considering the number of aliens for purposes of apportionment highlight how voters in congressional districts with high numbers of aliens effectively have more political power than citizens in districts with fewer aliens (one man one vote is undermined).

Supporters highlight how the Constitution requires all "persons" be included in the census and for purposes of apportionment.  (The Left also thwarted President Trump's attempt to include a citizenship question in the 2020 census.)

There is no doubt that the increasing foreign-born population has a significant impact on congressional representation. In 2019, the Center for Immigration Studies concluded that at least 26 seats in the House would be shifted after the 2020 census due to this foreign population.  CIS estimated "of the 26 seats that will be lost, 24 are from states that voted for Donald Trump in 2016."
