University chancellor fired after porn videos with wife surfaced says school violated his free speech

Former University of Wisconsin-La Crosse Chancellor Dr. Joe Gow spoke out on CNN this week after being fired from his position at the school following the discovery of pornographic videos he and his wife made and published to major porn websites.

Gow told CNN anchors Brianna Keilar and Boris Sanchez that the school’s decision to fire him was a violation of his First Amendment rights, and that he was given "no due process" in the decision.

He further insisted he violated no university policy by publishing the videos of him and his wife, and argued he had followed the school’s charge to him to "set a good example" and his videos set a good example for "free speech."  .  .  .

The Universities of Wisconsin Board of Regents unanimously voted to fire Gow Wednesday, with the body’s president Jay Rothman citing his "abhorrent" actions that "subjected the university to significant reputational harm."

"This Board is charged with the stewardship of our great Universities of Wisconsin. Unfortunately, Dr. Joe Gow has shown a reckless disregard for the role he was entrusted with at UW-La Crosse to serve students, faculty and staff, and the campus community," UW System Regent President Karen Walsh added in a separate statement. "The outrage over his behavior is evidenced by the unanimous vote by the UW Board of Regents to terminate him as chancellor. We are alarmed, and disgusted, by his actions, which were wholly and undeniably inconsistent with his role as chancellor."

Good for them.  Due Process served.  And no one denied him his right to free speech.  But the right to free speech does not include immunity to the consequences of free speech.

The rot in higher education runs wide and deep: Consider the case of Joe Gow, the now-former chancellor of the University of Wisconsin-La Crosse — removed from office after it was revealed he was posting X-rated videos of himself, his wife and even pro porn stars online.

This man is a public servant, with a whopping salary paid for by hardworking Wisconsinites; a chancellor at a major public research university, one with a deserved reputation for excellence.

This is how he repays the vast trust placed in him by the citizens of the Badger State, and the parents from all over the world who placed their kids under his care?  ...

In a (pseudonymous) book he wrote with his wife and co-star, the randy couple noted they were “fairly certain a scandal would ensue if our peers were to know about what we’ve been doing.”  ...

In 2018, after University of Wisconsin-La Crosse Chancellor Joe Gow invited onscreen prostitute Nina Hartley to speak on campus for “Free Speech Week,” he lost his raise. Ray Cross, the University of Wisconsin System president at the time, criticized the chancellor for exercising “poor judgment.”  ...

Gow asks, what’s the big deal? The disgraced administrator claims a First Amendment right to follow his “passion” in his spare time. Gow argues the regents appear to have violated his due-process rights.  ...

First Amendment attorneys say Gow probably doesn’t have a legal leg to stand on.

Ken White, founding partner at California-based law firm Brown, White & Osborn, in a recent substack post notes that First Amendment protections for government employees involve a “complicated analysis of whether the speech is part of the employee’s job, whether it’s on a matter of public interest, and whether the government employer’s interest in preventing disruption outweighs the employee’s interest in speaking.”

But in short, Gow is screwed.

“In balance, he’s probably not protected in his job as chancellor” because Gow’s public sexual proclivities present no public concern, as the U.S. Supreme Court has opined, White said. In 2004, the high court held that a San Diego police officer wasn’t exercising his First Amendment rights on a matter of public concern by selling pornographic videos of himself. He was fired.  ...
