University chancellor fired after porn videos with wife surfaced says school violated his free speech

Former University of Wisconsin-La Crosse Chancellor Dr. Joe Gow spoke out on CNN this week after being fired from his position at the school following the discovery of pornographic videos he and his wife made and published to major porn websites.

Gow told CNN anchors Brianna Keilar and Boris Sanchez that the school’s decision to fire him was a violation of his First Amendment rights, and that he was given "no due process" in the decision.

He further insisted he violated no university policy by publishing the videos of him and his wife, and argued he had followed the school’s charge to him to "set a good example" and his videos set a good example for "free speech."  .  .  .

"This Board is charged with the stewardship of our great Universities of Wisconsin. Good for them.  Due Process served.  And no one denied him his right to free speech.  But the right to free speech does not include immunity to the consequences of free speech.

Exactly right! He is free to continue with his "speech" as before he just can't do it as an employee of UW-La Crosse.

First Amendment attorneys say Gow probably doesn’t have a legal leg to stand on.

Ken White, founding partner at California-based law firm Brown, White & Osborn, in a recent substack post notes that First Amendment protections for government employees involve a “complicated analysis of whether the speech is part of the employee’s job, whether it’s on a matter of public interest, and whether the government employer’s interest in preventing disruption outweighs the employee’s interest in speaking.”

But in short, Gow is screwed.

“In balance, he’s probably not protected in his job as chancellor” because Gow’s public sexual proclivities present no public concern, as the U.S. Supreme Court has opined, White said. In 2004, the high court held that a San Diego police officer wasn’t exercising his First Amendment rights on a matter of public concern by selling pornographic videos of himself. He was fired.  ...
