Hunter Biden seeks to subpoena Trump, Barr in criminal case
by Zach Schonfeld - 11/15/23 10:42 AM ET

Hunter Biden requested Wednesday to subpoena former President Trump and three senior officials who served in his administration’s Justice Department, seeking evidence that Biden’s criminal prosecution is politically motivated.

Biden, who faces three federal gun charges, is demanding Trump and former Attorney General Bill Barr turn over communications and documents concerning the president’s son or his criminal investigation.

The demands for documents, which must be approved by a judge, also extend to former Deputy Attorney General Richard Donoghue and former acting Attorney General Jeffrey Rosen.

“Mr. Biden seeks specific information from three former DOJ officials and the former President that goes to the heart of his defense that this is, possibly, a vindictive or selective prosecution arising from an unrelenting pressure campaign beginning in the last administration, in violation of Mr. Biden’s Fifth Amendment rights under the Constitution,” Biden’s attorneys wrote in court filings.

After a plea deal evaporated in Biden’s case earlier this year, prosecutors in Delaware indicted the president’s son on three gun-related charges in September.

He is accused of unlawfully possessing a firearm while addicted to a controlled substance and failing to disclose drug use when seeking to buy a weapon. Biden, who has acknowledged his struggles with addiction, pleaded not guilty.

Republicans have long criticized the investigation into Biden, portraying his now-defunct plea agreement as a “sweetheart deal” and lambasting prosecutors for not charging him with additional crimes in their subsequent indictment.

Biden’s subpoena motion extensively references those criticisms, calling out by name House Oversight and Accountability Committee Chair James Comer (R-Ky.) and House Ways and Means Chair Jason Smith (R-Mo.). Biden accused Trump and his congressional allies of mounting a “sustained, almost-nonstop public pressure campaign” for prosecutors to bring charges.

Isn't it Hunter Biden's Daddy's DOJ now?

It's the burden of the prosecution to prove, beyond a reasonable doubt, that a crime has been committed by the defendant.

It doesn't matter who dropped a dime to the cops.  If a crime has been alleged, it should be investigated.

Hunter Biden Seeking Trump, Barr Documents in Gun Case
Story by C. Ryan Barber  •  1h

President Biden’s son, Hunter Biden, is seeking to subpoena Donald Trump and former Attorney General William Barr as he prepares to raise a defense that his prosecution on felony gun charges stems from an “unrelenting pressure campaign” by the former president and his Republican allies.

In a 16-page court filing Wednesday, the younger Biden asked a federal judge to sign off on subpoenas for communications among Trump administration officials about investigating and prosecuting him. His lawyer, Abbe Lowell, said the information he is pursuing “goes to the heart of his defense that this is, possibly, a vindictive or selective prosecution arising from an unrelenting pressure campaign beginning in the last administration.”

Biden, 53, pleaded not guilty last month to three felony charges related to his purchase of a firearm from a Delaware gun shop in 2018. His indictment on those charges followed the collapse of a plea deal in which he was set to plead guilty to a pair of misdemeanor tax charges and avoid prosecution on a gun charge.

In the court filing Wednesday, Lowell asked the federal judge presiding over the criminal case to approve subpoenas to Trump and Barr to gather more information about “certain instances that appear to suggest incessant, improper, and partisan pressure applied” by the former president on Barr and other top Justice Department officials. In addition to Trump and Barr, the younger Biden hopes to issue subpoenas to the two top-ranking Justice Department officials at the end of the last administration: former acting Attorney General Jeff Rosen and his deputy Richard Donoghue.

So, Hunter's defense is that he got caught, and that, because of his White Privilege, he shouldn't be prosecuted?

There could be legal discovery blowback on this one ... some evidence of the Chi-com and Burisma dealings could make their way to the trial via Trump's legal team.
