 Judge agrees to ‘narrow’ gag order limiting Trump attacks on witnesses in Jan. 6 case

A federal judge said Monday that she would impose a gag order barring former President Trump from attacking future witnesses in his election interference case, as well as prosecutors, court staff and their families.

Judge Tanya Chutkan said Trump’s status as a candidate did not give him carte blanche to level a “smear campaign” against those involved in the case, saying that “First amendment protections yield to the administration of justice and to the protection of witnesses.”

She declined however, to grant an order with the breadth requested by the Justice Department in September, declining to limit any speech attacking her or the District of Columbia, saying the court would use the jury selection process to ensure it does not pick jurors swayed by Trump’s repeated attacks on the city.

The extent of Chutkan’s order was not entirely clear, saying she would describe only the “contours” of her decision Monday, while drafting a formal ruling later.

The DC Circuit must fix DC Obama Judge Tanya Chutkan's clearly erroneous ruling.

Somebody who doesn't understand what the word "clearly" means.  Also, somebody who didn't read the judge's actual order, because she did not prevent Trump from criticizing herself.

    Judge Tanya Chutkan issued a gag order against former President Donald Trump Monday restricting his statements about special counsel Jack Smith, his staff, witnesses, and court personnel.

    Placing a gag order on a presidential candidate is unprecedented, legal experts said.

    “Not only have we never before had a former president or leading presidential candidate being indicted in four different felony cases with 91 counts across those four cases, but we’ve also never, to my knowledge, had a leading presidential candidate who has had a gag order issued against him basically limiting what he’s allowed to say on the campaign trail,” Zach Smith, Heritage Foundation legal fellow and former assistant U.S. attorney, told the Daily Caller News Foundation.

Judge Tanya Chutkan’s decision to place a gag order on former President Donald Trump is unprecedented, legal experts said Monday.

Chutkan issued a gag order following a hearing Monday restricting Trump’s statements about special counsel Jack Smith, his staff, witnesses, and court personnel. While less expansive than the order requested by prosecutors, legal experts said it is nevertheless the first gag order to be placed on a presidential candidate and will present problems for the former president on the campaign trail, making a swift appeal likely.

Zach Smith, Heritage Foundation legal fellow and former assistant U.S. attorney, told the Daily Caller News Foundation this is a “very serious matter.”

“Not only have we never before had a former president or leading presidential candidate being indicted in four different felony cases with 91 counts across those four cases, but we’ve also never, to my knowledge, had a leading presidential candidate who has had a gag order issued against him basically limiting what he’s allowed to say on the campaign trail,” he told the DCNF.
