National Archives acknowledges 5,400 Biden pseudonym emails, faces lawsuit for their release

The new lawsuit turns up the pressure on the archives to release the documents.

The National Archives and Records Administration acknowledged possessing potentially up to 5,400 emails connected to then-Vice President Joe Biden's pseudonym accounts that he used to forward government information and discuss business with his son, Hunter Biden, and others, and on Monday the Southeastern Legal Foundation filed a lawsuit to compel the agency to turn over the emails.

The non-profit constitutional legal group that filed the lawsuit said the archives confirmed that Biden used the pseudonyms of Robin Ware, Robert L. Peters, and JRB Ware during his time in the Obama administration.

The archives' admissions confirm years of reporting from Just the News about Biden's use of a personal email as vice president and the pseudonym accounts he used.

The legal foundation first filed a Freedom of Information Act request to the archives for Biden's emails in 2021 on behalf of Just the News editor-in-chief John Solomon.

The legal foundation renewed its initial request last year with a second FOIA request, but the archives "has failed to produce a single one of these emails," the group said.

Monday's lawsuit turns up the pressure on the archives to release the documents.

NARA is slow-walking this info request. If it ever delivers, it'll probably be after the first week of November 2024. IF.

The White House cited executive privilege in withholding hundreds of emails relating to Hunter Biden’s business dealings and then-Vice President Joe Biden requested by America First Legal (AFL), according to records requests returned to the legal firm.

AFL released three batches of emails Wednesday that the National Archives provided in response to its August 2022 records request, which included over 1,000 emails between Hunter Biden’s consulting firm Rosemont Seneca and the Office of Vice President. Among others withheld by the White House, 200 emails were kept back because they “would disclose confidential advice between the President and his advisors, or between such advisors,” according to letters from the National Archives.

President Joe Biden has previously claimed that he never spoke with his son about his business dealings overseas.

Executive Privilege is meant to apply to communications and activities that are official conduct of the Executive.

If Biden used an alias, and not his formal Presidential E-mail address and account, those E-mails were not "official", and thus not covered by Executive Privilege.

Executive Privilege may not apply to criminal behavior done outside the official duties of the Office.

Executive Privilege is not a blanket Get Out Of Jail Free Card.

Congress should take the assertion to adjudication to get copies of those E-mails.

Executive privilege applies to the individual who occupies the office of president, regardless of what label is being used in any particular instance.
