A California church fined $1.2 million for defying Covid lockdowns filed a lawsuit against the government for spying on its congregants.

Calvary Chapel San Jose was harassed and fined by Santa Clara County for ‘violating’ the Covid lockdowns and mask mandates.

Pastor Mike McClure in his lawsuit accused Santa Clara County of “an invasive and warrantless geofencing operation” to spy on worshippers.

The government used mapping software to track worshippers to see when they were on the church premises

This is not just un-American; it is downright Orwellian,” the complaint says according to Fox News.  ...

The defendants are accused of using geofencing, a location-based tool used by the government to track individuals through their cellphone data, around Calvary Chapel San Jose property so they could see when and where worshippers were on the premises.  ...

The Founders could never have seen what was coming, and the current U.S. Constitution as it exists today is woefully unable to protect citizens any longer.

That's why a new "Reconstituted Constitution" should include the following article:

Citizens protected by this Constitution possess an inalienable right to privacy in their persons, businesses, and homes, and while they are in public.

It shall be a violation of this Constitution for the United States or for the several States or for any private citizen or entity to violate or invade the individual privacy of citizens by use of physical, mechanical, digital or electronic means or by the use of devices on land, on water, below the ground, or from the air.

This protection shall extend to all lawful communications and acts by an individual citizen or between two or more citizens, including content that is spoken, written, or electronically transmitted. It shall extend to citizens regardless of their location, whether in private or in public.

The only exceptions will be as governed by the Fourth Amendment of this Constitution.

Santa Clara County public health spied on Calvary Church using cell phone geolocation company SafeGraph data. The company just announced that this use of its data violated its terms of service.
