Judge blocks Arizona county from hand-counting ballots

McGinley said the Cochise County Board of Supervisors overstepped its authority by ordering the hand count of all ballots cast in the midterm election rather than the sample allowed by state law.

The Arizona Alliance for Retired Americans filed the lawsuit to stop the hand count. It argued state law only allows a small number of ballots to be counted by hand to ensure voting machine accuracy and that a hand count could cause a delay in certifying the election results, the Associated Press reported.

Wisconsin judge won’t order sequestering of absentee military ballots

A Wisconsin judge on Monday, less than 14 hours before polls opened, refused to order that military absentee ballots be pulled aside and sequestered until it can be verified that they were cast legally, saying that would be a “drastic remedy” that could disenfranchise voters...

...Waukesha County Circuit Judge Michael Maxwell denied that request for a temporary restraining order in a ruling from the bench following a two-hour hearing Monday afternoon.

Turnout is very heavy, very early in Maricopa. This is a real serious problem. No voter should ever have to leave their ballot in a box in the corner of the room and expect it to be handled properly at some point later.

It's a chain of custody nightmare and easily exploitable.

Mercer (county NJ) has countywide vote tabulator glitch, but voting by machine continues

Voting machines throughout Mercer County are facing technical difficulties this morning, but no voters are being turned away and machine votes are still being cast.

The issue involves a programming glitch with optical scanners, which count votes after ballots are filled out.

Programmers from the voting machine manufacturer, Dominion, are in site trying to work through the problem, the New Jersey Globe has confirmed.

“There is a slot on the top of the scanner and voters can vote and are voting manually,” said Mercer County Clerk Paula Sollami Covello.  “We are asking poll workers to use the official ballots because they can still vote them manually, and place them in the slot in the scanning machines and we will count them manually.”

Florida Department of State Rejects Federal “Election Monitors” – Puts Biden’s DOJ On Notice

The Florida Department of State warns Biden’s DOJ that if any federal “election monitors” are sent into polling places, State resources will be dispatched “to ensure that no interference with the voting process occurs.”

After the Department of Justice announced that they will send “election monitors” to Broward, Miami-Dade and Palm Beach counties, the DeSantis administration has issued a strongly-worded response.

On Monday, Brad McVay, General Counsel with the Florida Department of State, wrote a letter to the Department of Justice’s Civil Rights Division:

“Earlier today, the Florida Department of State received copies of your letters to Miami-Dade and Broward Counties in which you seem to indicate that the Department of Justice will send monitors inside polling places in these counties. We also understand you sent a similar letter to Palm Beach County,” McVay wrote.

He then stated that federal election monitors are not permitted under Florida law:

“Section 102.031(3)(a) of the Florida Statutes lists the people who ‘may enter any polling room or polling place.’ Department of Justice personnel are not included on the list.”

Within hours of polls opening in Pennsylvania Tuesday morning, a "last minute change" is already causing vote count delays in notoriously corrupt Philadelphia. Before the change this morning, votes in the city were expected to be fully counted by Wednesday morning.

    City officials voted Tuesday morning — as polling places opened and the vote count began for the midterm elections — to reinstate a time consuming and labor-intensive process for catching double votes that will slow how quickly they can report results.

    If Pennsylvania’s high-stakes U.S. Senate race is as close as expected, a wait for results out of the state’s largest city is sure to shine a national spotlight on Philadelphia, similar to after the 2020 presidential election.

    The city commissioners, the three-member elections board, voted 2-1 to reinstate what is known as poll book reconciliation — a means of flagging mail ballots submitted by voters who also voted in person — during an emergency 7 a.m. meeting.

    It was a sudden reversal of a decision they made less than a week ago and came a day after a city judge, responding to a Republican lawsuit, said they could move forward without the process.
