Paxton says the mandate was “unlawfully issued.”

Texas Attorney General Ken Paxton, alongside the Texas Public Policy Foundation and U.S. Rep Beth Van Duyne (R–Irving), is suing the Biden administration for its illegal mask mandate for airlines and airports.

Since the Centers for Disease Control and Prevention’s (CDC) mandate was not authorized by Congress and did not go through the administrative process of notice and comment (generally required for regulations of this sort by an administrative agency), Texas AG Paxton says the mandate was “unlawfully issued.”

“Biden’s repeated disregard of the individual liberties of Texans is not only disrespectful to the U.S. Constitution, it is also troublesome that any president thinks they can act above the law while hardworking Americans standby,” said Attorney General Paxton.

The full complaint filed by Paxton can be read here.
