National Archives asked DOJ to probe Trump's handling of White House records: report

The National Archives has asked the Department of Justice (DOJ) to look into former President Trump's handling of White House records since leaving office, The Washington Post reported on Wednesday, amid revelations in recent days that he had retained official documents that should have been turned over.

According to the Post, the National Archives' referral has prompted internal discussions among federal prosecutors about potentially investigating whether Trump committed a crime in not properly turning over the records.

It's reportedly unclear whether the DOJ will mount such an investigation.

Neither the National Archives nor the Justice Department immediately responded when asked for comment.

The Post reported earlier this week that Archives officials recovered 15 boxes of documents from Trump's Mar-a-Lago estate last month that the former president was legally required to turn over upon leaving office. And according to various news reports in recent years, Trump had a habit of tearing up documents that were supposed to be preserved.

Mar-a-Lago was not raided: Trump hands over 15 boxes of presidential records to National Archives

Former President Donald Trump handed over 15 boxes of “mementos, gifts, letters from world leaders, and other correspondence” that were being stored at Mar-a-Lago to the National Archives as they requested in January, but the club was not raided and the records were not seized.

Schiff: Trump Can Be Prosecuted for ‘Willfulness in the Destruction of Documents’

Representative Adam Schiff (D-CA) said Wednesday on CNN’s “Anderson Cooper 360” that former President Donald Trump could be prosecuted for “willfulness in the destruction of documents” belonging to the United States under the Presidential Records Act.

Guest host John Berman said, “I want your take — the fact the National Archives is asking the Justice Department to investigate the former president’s handling of these White House records. Do you think there’s any possible criminal exposure, particularly if there are any classified documents he took to Mar-a-Lago as The New York Times is reporting tonight?”

Schiff said, “Well, first of all, I think they are absolutely right to make the referral to the Justice Department because there’s public reporting, and the archives may know more than this, that the president was repeatedly warned that he couldn’t destroy these documents, that he would be violating the law if he did so. And so it looks very willful. And if there’s evidence of potential willfulness in the destruction of documents, that is the kind of case if any case is going to be prosecuted might be prosecuted.”

He added, “If it were to happen, it’s a case like this where it appears to bow a willful decision. And the classified allegation is much more serious in my view. That is that Donald Trump brought to Mar-a-Lago in an un-secure location in boxes that others may have access to classified information. If that allegation proves, correct the Justice Department, in my view, will have to investigate.”

House Oversight Committee launches probe into boxes of Trump presidential records

The House Oversight Committee announced on Thursday that it is launching a probe regarding the boxes of former President Trump’s records that had been recovered by the National Archives and Records Administration (NARA) that had previously been at his Mar-a-Lago residence.

In a letter to David S. Ferriero, archivist to the United States, committee chairwoman Rep. Carolyn Maloney (D-N.Y.), said she was “deeply concerned that these records were not provided to NARA promptly at the end of the Trump Administration and that they appear to have been removed from the White House in violation of the Presidential Records Act (PRA).”

She said she was also concerned about recent reports that suggested “President Trump repeatedly attempted to destroy presidential records, which could constitute additional serious violations of the PRA.”

Trump: Return of documents to Archives viewed as routine and 'no big deal'

Former President Trump on Thursday responded to recent reports about his handling of White House records, claiming that the recent transfer of documents to the National Archives and Records Administration (NARA) from his resort in Florida was viewed as "no big deal."

In a statement, Trump said he arranged for boxes containing "letters, records, newspapers, magazines, and various articles" to be transported to the National Archives after "collaborative and respectful discussions."

"The media’s characterization of my relationship with NARA is Fake News. It was exactly the opposite! It was a great honor to work with NARA to help formally preserve the Trump Legacy," he said.


Earlier this week, The Washington Post reported that the National Archives had recovered 15 boxes of White House records from Mar-a-Lago. The New York Times later reported that possibly classified materials had been discovered among the recovered documents.

Trump documents taken to Mar-a-Lago marked 'top secret:' report

Some documents former President Trump took to his Mar-a-Lago residence were reportedly marked as “top secret,” according to a new report by The Washington Post.

Citing two people familiar with the matter, The Post reported on Thursday that some of the documents Trump took back to his Florida club after departing the White House were clearly labeled as classified, while some were marked as “top secret” — which is the highest level of classified information.

It is unclear how many classified documents were recovered by the National Archives, according to The Post. Two sources told the newspaper that some records had labels signaling that the information within was very sensitive and would only be available to few people with clearance high enough to review such details.
