A) The 1/6 committee has taken the extraordinary move of issuing subpoenas for sitting lawmakers who have not agreed to cooperate with the investigation.
B) The subpoenas include House Minority Leader Kevin McCarthy (R-CA), Rep. Andy Biggs (R-AZ), Mo Brooks (R-AL), Jim Jordan (R-OH) and Scott Perry (R-OH). Such a move is exceptional because the Constitution gives the House and Senate the right to discipline its own members.
C) So, a subpoena in this case is only enforceable if the House were to take them to court. That creates a Constitutional problem. The House has a conventional ethics process where members can be referred to the Ethics Committee.
D) Moreover, if the lawmakers don’t comply with the subpoena, the House could potentially vote to hold those members in contempt and refer them to the DoJ for prosecution.
