A federal judge Wednesday night blocked a new Texas law that banned abortions after six weeks and allowed private citizens to file lawsuits against anyone who facilitated the procedure.

U.S. District Judge Robert Pitman in Austin issued a preliminary injunction forbidding state court judges and clerks from accepting suits under the new law, commonly known as Senate Bill 8, which went into effect last month. The Biden administration’s Department of Justice had asked for the injunction as part of a lawsuit it filed against the state last month.

In his 113-page ruling, Pitman wrote that the law was designed to circumvent a woman’s constitutional right to abortion.

“From the moment S.B. 8 went into effect, women have been unlawfully prevented from exercising control over their lives in ways that are protected by the Constitution,” the Obama appointee wrote. “That other courts may find a way to avoid this conclusion is theirs to decide; this Court will not sanction one more day of this offensive deprivation of such an important right.”

Robert Lee Pitman is federal judge on the United States District Court for the Western District of Texas. He joined the court in 2014 after a nomination from President Barack Obama.

What Constitutional right to abortion?

In the 113-page ruling, the term 'constitution' appears 238 times.  The term 'Fourteenth Amendment' appears 30 times.  Yet not once is any wording of the Constitution ever cited.  Abortion is a constitutional right simply because this judge deems it so, not because the Constitution actually says it.
If a political party does not have its foundation in the determination to advance a cause that is right and that is moral, then it is not a political party; it is merely a conspiracy to seize power.

The Fifth Circuit already ruled it can stay.

Some low-level liberal district court magistrate trumps a US Appellate Court every time, don't-cha-know.
