One of Vice President-elect Kamala Harris' first tasks in her new job could be to preside over an impeachment trial of President Trump.

Politico reported on Tuesday that Chief Justice John Roberts "wants no further part" in overseeing the politically charged situation after he presided over the first impeachment trial of Trump less than one year ago.

The Constitution says that in impeachments for presidents, the chief justice of the Supreme Court is the presiding officer. For lesser impeachments, the presiding officer has been the same as for other Senate business — either the vice president or a senator. The Constitution is not clear on who should preside over impeachments for former presidents.

If Roberts does not preside over a Senate trial, Harris would likely have the choice of whether to preside herself. The transition organization for the incoming Biden administration did not respond to a request for comment asking whether Harris would do that.

The Dersch was as surprised as the rest of us when the SCOTUS blew off the election and refused standing to TX.  The SCOTUS has gone completely rogue, and will not be deciding an ex-President cannot be Impeached.  They'll just say "It's up to Congress."

Lots of legal scholars are weighing in on this with most stating that it makes little sense to impeach him after he leaves office as the Senate's purpose is to vote removing him from office.

Perhaps the Senate will take up the vote tomorrow; if so, I am hoping that we see some Senators walk.  IMHO Trump is one of the best President we've had and to impeach him twice shows how deranged they are and disconnected from the rules set forth in the Constitution.

As a note; The Supreme Court ruled unanimously in 1993 that whatever rules the Senate adopts for impeachment, under the Constitution those rules are not reviewable by the Supreme Court as long as the Senate follows three requirements specified in the Constitution: that the Senators be "under oath and affirmation," that "a two-thirds vote is required to convict, and that the Chief Justice presides when the president is tried."

We shall see what unfolds tomorrow.  At best, no impeachment trial tomorrow and JoBama is sworn in and 30,000 National Guardsmen have been called up for nothing.

At this point in time, I think that they will overlook anything that they want to in order to try and save their own skins.  They've all pretty much spit on their oath of office.

As the issue has been decided and ended tomorrow,what's the point of all the fretting that needed to have been done when it could of made a difference. Get yourself a De Lorean and go back to the future, your chance of making a difference is more likely than Johnny come lately and a dollar short now.

They are talking about "summoning" him. And I bet dollars to donuts they will not let the Trump team present any of the evidence supporting his belief that there was widespread election fraud.

Thats a good point. If Trump was to participate in this sham at all he should demand the opportunity to present evidence of election fraud as integral part of his defense.

They will deny him the opportunity, at which point I would tell em to come and get me.
