Article II, Section 2 of the U.S. Constitution provides that:

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

Thus, when the Senate is in recess, the President may make a temporary appointment to any office requiring Senate approval, including filling vacancies on the Supreme Court, without the Senate's advice and consent. Such a recess appointee to the Supreme Court holds office only until the end of the next Senate session (always less than two years).

Majority in poll before Ginsburg's death supported holding hearings in 2020

A majority of Americans said in a new poll conducted prior to Justice Ruth Bader Ginsburg’s death that the Senate should hold confirmation hearings on a Supreme Court nominee for any vacancy this year.

Sixty-seven percent of Americans said in the Marquette University poll released Saturday that hearings should be held, while 32 percent said the Senate should not consider a nominee to the high court in an election year.

Results did not significantly vary along party lines, with 71 percent of independents, 68 percent of Republicans and 63 percent of Democrats saying confirmation hearings should be held.

Ginsburg screwed the ones who idolize her.  She just "knew" Hillary would be the President following Obama.  She then tried to run the clock hoping against hope she could make to the next guy and that it would be someone other than President Trump. 

I've slept on it.  The President must move quickly and nominate the next Justice.  Like most, Amy Coney Barrett would be my choice.

I’m all for women in politics and government. As long as they have been certified as having successfully completed de-programming and/or gone through a family intervention to release (and save) them from their leftist indoctrination.

This administration needs to make clear to Americans the benefit to every one of us of having Constitutionalist jurists on SCOTUS, opposed to coercive progressives.

Yes, adherence to the Constitution should be a no-brainer for anyone who serves in government, but especially for anyone on the USSC.   Instead, those words "adherence to the Constitution" are dirty words to the radical left.
