New York suing feds over Homeland Security’s decision to ban state residents from ‘trusted traveler’ programs

Gov. Cuomo announced Friday that the state will sue the Trump administration following the Department of Homeland Security’s decision to ban New Yorkers from the Trusted Traveler Program.

The lawsuit, which will be brought by New York Attorney General Letitia James, will argue that DHS violated New York’s sovereign immunity, failed to provide residents with equal protection and is acting in an “arbitrary and capricious manner” that denies the rights and privileges of all New Yorkers.

Federal authorities said this week that the decision to bar New Yorkers from enrolling in programs that expedite border crossings was made in response to the state’s “Green Light Law” that allows undocumented immigrants to obtain driver’s licenses and prevents DHS from accessing Department of Motor Vehicle data.

Once again,Trump does the right thing,gets no credit for it from the alleged Republicans,and gets hammered by the left.

The DHS ban won't stop New Yorkers from international travel, they can still come and go as they please.  They just won't be able to come back into the country using the shorter Global Entry lines.  Global Entry also includes TSA pre-check, so I guess they would have to go in the regular line for TSA security for domestic travel as well.

The question is, why is New York giving protection to potential criminals at the expense of law abiding citizens?

Nothing arbitrary about that.  DHS relies on State data for its more extensive travel plans. If the State of New York refuses to share Motor Vehicle data with DHS, then DHS is perfectly within their authority to reject any future applications for non-compliance.  A citizen of New York should have the ability to compel the State to release such data on his/her behalf in order to meet such compliance for Nexus, Global Entry, etc.  And if the State of New York denies such a request from one of its own citizens, then it will actually be the State of New York who is guilty of the equal protection violation that they accuse the Trump Administration of.

DHS should take the additional step here of no longer allowing New York driver licenses as a form of ID for TSA PreCheck.  If a New Yorker wants to use TSA PreCheck, then they will need a US Passport, TWIC card, or some other form of accepted ID.

I wonder if this has any affect on whether or not New York driver's licenses are Real ID compliant?
