California federal judge reimposes nationwide ban on Trump asylum policy, defying appeals court

A federal judge in California has defied an appeals court in reinstating a nationwide injunction over the Trump administration’s ban on asylum for anyone trying to cross the southern border by transiting through a third country, such as Mexico.

The injunction blocks enforcement of the policy across the four states along the U.S.-Mexico border.

The order follows a federal appeals court decision last month narrowing the scope of that injunction to just California and Arizona. The ACLU and other groups then went back to the district court seeking to have the nationwide injunction reimposed, which the district court now has done.

Why would this judge believe his ban will be complied with while he himself shows contempt for other courts? C'Mon SCOTUS do your damn job now.

I'm no lawyer, but my understanding is that while judges in other circuits may take guidance from a decision by a Ninth Circuit (or any other circuit) court, it isn't binding nationally unless the USSC affirms it. That the Ninth Circuit Court of Appeals (!!!) slapped down this judge's original overreach probably reflects that. So they are likely again to slap down this judge.

IMO, a judge who doubles down on overreach the way this character did should be impeached and removed for tyranny.

It reminds me of the time some obscure unknown Federal Judge in Hawaii struck down Trump's global immigration policies. Essentially the Judge said, 'You may be the President of the United States, but I am the guy who really in charge. You must obey me!'

This is not SCOTUS. It is just guy somewhere who decided NO! Trump and the entire country are going to do thing 'my way'. I am in charge here dammit! For the life me, I will never understand how this is possible anywhere in any country, much less in the United States.

9th Circuit Court Places Hold on Nationwide Injunction Against Trump Asylum Limits

A federal appeals court has put on hold a ruling that blocked a Trump administration policy that would prevent migrants from seeking asylum along the entire southwest border.

The 9th U.S. Circuit Court of Appeals issued a stay Tuesday that put the ruling by U.S. District Judge Jon Tigar on hold for now.

That means the administration’s asylum policy is blocked in the border states of California and Arizona but not in New Mexico and Texas.

A double smack-down!   By the 9th US Circuit Court of Appeals!   Whatever the appeals court's justices' opinions of Trump's policy, a district court's jurisdiction - right to speak - is limited to the circuit in which the district court is located.   Even the 9th US Circuit Court of Appeals couldn't bring itself to permit this judge's attempted tyranny.

Acting at the request of the Trump administration, the 9th Circuit Court of Appeals issued an administrative stay Tuesday night that put on hold the injunction issued Monday by San Francisco-based U.S. District Court Judge Jon Tigar.

The temporary hold implemented while the appeals court considers a longer stay essentially restores the legal situation that existed prior to this week, with Trump’s policy blocked only in the Ninth Circuit, which includes the border regions of California and Arizona.

This just keeps Trump's policy in force nationwide while the ACLU's, etc.'s lawsuit wends its way through the courts. That this district court judge twice tried to overstep his authority, the second time in defiance of the circuit's court of appeals, could provide basis for a motion to have Judge Jon Tigar removed from the case for having demonstrated prejudice.

The Trump administration has worked to make the 9th Circuit a moderate court and it seems to be working.

The longtime liberal circuit lifted a nationwide injunction on President Trump's new asylum policy on Monday night.

According to Fox News:

    The 9th Circuit Court of Appeals – long a liberal bastion that has been aggressively reshaped into a more moderate court by the Trump administration – handed the president a major win late Monday, lifting a nationwide injunction on his asylum policy.
