Well then the problem is Lawyers because Lawyers are people. Kinda shot your argument in the ass. Glad I don't have you on retainer. I'd be doing a double nickle right now for some past malfeasance I can't go into.

Well there is that difference between a good lawyer and a bad lawyer...

A bad lawyer can let a case drag out for several years. A good lawyer can make it last even longer.... :laugh:

I was just notified that we will have to shut this thread down immediately. The ABA just sent a Cease and Desist letter. They are not happy with the quality of the jokes being made at their expense.

Well it's popular in today's America to blame the lawyer but the basic fact is that it's the people bringing the lawsuits that are to blame.... not the lawyers.

Having a lawyer with "skin in the game" is a two edged sword, in my experience there are just as many folks on the right as there are on the left who bring questionable claims. It kinda reminds me of people blaming the fire arm for mass shootings, rather than the individual pulling the trigger..... :shrug:

That isn't my point. A lawyer would be far less likely to roll the bones on a thing if he stood to actually lose money... Not losing a contingent fee... but actually having to dig his wallet out of his pants.

As it is, unless it is pro-bono, the lawyer walks away without harm... and probably paid. The lawyer doesn't lose (in real terms).

If they pay too when they lose, suddenly, activism becomes expensive.

The American judicial system is based on the simple premise that everyone, regardless of their economic circumstances, is able to seek redress in the Courts if they rightly (or wrongly) believe they have a case. The services of a lawyer are simply the tool that gives everyone access to the judicial system.

There would be far fewer lawyers in this country if society as a whole didn't look at the judicial system as a way to make a quick buck and only brought meritorious cases...the  problem is the litigants not the litigators... :shrug:

If it were any other way then the individual Constitutional guarantees would be null and void and the individual would be just a subject of the state...the reason that monarchy thing didn't work out here...

I would say both are the problem. It isn't about the law in either direction. It's about the money.

Suit should be tossed out from the get go.  The defendant is 19, and an adult, and the family took no legal guardianship of him.

It's a shame they're going to have to spend their money defending themselves in a completely frivolous suit.

Why sue them even if they did?  I can't see that they did anything wrong.  They were being compassionate and now will have to pay for that.
