Commentary: Our lawless judiciary threatens the constitutional balance of powers like never before
Apr 26, 2018 1:55 pm

In case you missed it, a federal judge ruled earlier this week that the Trump administration could not end the Deferred Action for Childhood Arrivals program that was instituted via executive fiat by his predecessor. Astonishingly, the judge — a George W. Bush appointee — ruled that not only could the Trump administration not deport current DACA recipients, but that they had to continue taking new applicants for the DACA program.

You don’t have to like President Trump’s decision with respect to DACA to have a vested interest in defending his right to make it. If presidents are allowed to make executive policy that cannot be undone by their successors, then courts are essentially granting them the power to make actual permanent law by fiat.

The president’s potential power as a lawmaker is extraordinary. The founders considered it unwise to vest the ability to make actual laws in the hands of a single person....

So the bottom line is, since the Republican Party and Congress had surrendered some key duties and authorities to the Executive branch for Obama and refused to do it's duty to restrain overreach and corruption in others because of Obama/Clinton - when the Executive is a Marxist and creates law by Executive fiat (read Decree), then the courts have ruled that their decrees are permanent and unchangeable and MUST be carried out, regardless of the make up of Congress or the Executive.

Oh yes.  The Republic is officially over.

We're all just too afraid to admit it to ourselves.
Fart for freedom, fart for liberty and fart proudly.  - Benjamin Franklin

...Obsta principiis—Nip the shoots of arbitrary power in the bud, is the only maxim which can ever preserve the liberties of any people. When the people give way, their deceivers, betrayers and destroyers press upon them so fast that there is no resisting afterwards. The nature of the encroachment upon [the] American constitution is such, as to grow every day more and more encroaching. Like a cancer, it eats faster and faster every hour." - John Adams, February 6, 1775

Congress will never do anything about judicial overreach. Its just too damn convenient to have the courts implement unpopular policies their major contributors want and that the public would never let them get away with themselves.

BINGO.

That, and imposing Statism is not too popular - so having the courts force it down everyone's throat is the mechanism used to make tyranny "legal".
