Federal Judge Orders Complete Restart Of DACA

A federal judge delivered another blow to President Trump’s attempt to roll back the Obama-era DACA program, ruling Tuesday that last year’s revocation was illegal and the entire program could have to be restarted.

That goes beyond decisions by other judges, who also ruled the phaseout illegal but ordered Homeland Security to accept renewal applications only from illegal immigrants who had been awarded DACA status before. Judge John D. Bates’ ruling would require a full restart, meaning even illegal immigrant Dreamers who had never been approved would now be able to apply for the deportation protections and regularized status that DACA provides.

This judge can't order shit.  It is federal matter.  Get this to the SC ASAP.

   How can you f*c this up it was an EO to begin with (actually an Executive Memorandum), should have just EO'd it out of existence on Day 1 as he promised for a year.   Art of the Deal, my azz.

He would have needed to wait until Gorsuch was seated, but you’re correct, otherwise.  It would have been through the system, before SCOTUS, and likely decided by now.

John Deacon Bates (born October 11, 1946), is a Senior United States District Judge of the United States District Court for the District of Columbia. He was appointed by President George W. Bush in December 2001, and has adjudicated in several cases directly affecting the office of the President.

This was a federal judge.

In the past, jurisprudential concerns have meant that most federal judges wouldn't issue a nationwide order, though technically, they have the power.  Now, they're just getting so overtly political that they don't care if they screw up the balance of powers.

The GOP should pass a bill limiting the ability of district court judges to issue injunctive relief against the federal government outside of their state or district.  It would be perfectly constitutional, and would at least partially solve the problem of runaway district court judges trying to set national policy.

Unless a president is psychic, clairvoyant and/or a fortune teller and mind-reader (and so far, none have been)....

there is no way for any president to know how any judge will rule in the future.

Yeah I'm confused too as to how the judge can rule on an EO.

And if IIRC Obama put the sunset deadline into the DACA EO from the start.  All Trump is trying to do is carry out the EO Obama signed...and that includes letting it die.

I'm not faulting Gorsuch for his recent decision.  He said the bill was poorly written and it was. It showed me that Gorsuch will vote his conscience and not the party line if he disagrees.

I think he will do the right thing in the future.
