I once worked for an attorney who specialized in defending companies sued by employees or their estates after the employees developed cancer (usually mesothelioma) allegedly from exposure to asbestos or other harmful substances in the workplace. In preparing a defense, the boss usually conducted an inquiry into the employee's everyday life to look for other possible causes of the employes's illness. For example, did he smoke? Did he use any toxic substances in and around his home on a regular basis?
I don't wish to disrespect Mr.Phelan, but it is possible that there were other reasons for his untimely death. I'm sure if there is a wrongful death lawsuit, both sides will trot out experts saying yes, it was the fumes, or no, it wasn't. I guess we will never know for sure one way or the other.
