SAN FRANCISCO (KGO) --
In a surprising verdict, the jury of six men and six women deliberated and came back with a not guilty verdict for Jose Ines Garcia Zarate. The defendant was facing second degree murder charges for killing 32-year-old Pleasanton resident Kate Steinle on July 1, 2015 at Pier 14 in San Francisco. While Garcia Zarate can technically walk out of the courtroom, it's expected that he will be taken into custody by Immigration officials and eventually deported back to his native Mexico.

I listened to a legal analysis a few days ago, and the point was 2nd degree murder was too hard to prove intent.

So he walks, since the prosecution overcharged what they could prove.

Should have been charged with manslaughter, which the facts did support; did not require PROVING intent.

So they can see me with it in my hand before, and see me with a smoking gun afterwards but as long as no one sees me actually fire the gun they can't prove murder.

This was a political verdict. Can't have the policies they're so proud of called into question by the rubes in the rest of the country.

If the jurors/powers that be in SF think this will end the controversy over sanctuary cities or thought it would be fun to poke their critics in the eye with this verdict I do not think its ultimate effect will be quite as they believe.
