Lawrence Tribe: ‘High crimes' in Trump’s firing of Comey

Harvard professor and constitutional law expert Lawrence Tribe on Thursday called President Trump's firing of FBI Director James Comey "staggering" and said Trump obstructed justice by asking for Comey's loyalty.

"That is, clearly, on it's face obstruction of justice," Tribe said on MSNBC on Thursday, referring to reports that Trump asked Comey for his "loyalty" at a private dinner.

Tribe said that Trump's request translated to mean that Trump wanted assurances from Comey that he would not become part of the FBI's investigation into Russian election interference.

"What it really means is, ‘Can I count on you not to make me a target of this investigation”’ ” Tribe said. "That's clearly an impermissible question."

An absurd argument is now being put forward by some Democratic ideologues: namely that President Trump engaged in the crime of obstructing justice by firing FBI Director James Comey.

Whatever one may think of the president's decision to fire Comey as a matter of policy, there is absolutely no basis for concluding the president engaged in a crime by exercising his statutory and constitutional authority to fire director Comey. As Comey himself wrote in his letter to the FBI, no one should doubt the authority of the president to fire the Director for any reason or no reason.

It simply cannot be a crime for a public official, whether the president or anyone else, to exercise his or her statutory and constitutional authority to hire or fire another public official.

I always confuse Tribe with the guy who represents Crockett, Lewis & Clark.

Donny should resign then because as far as he is concerned, Larry Tribe is a very very smart man....

Prompted by the Fox Business Network moderators, Trump again cited Larry Tribe, a law professor at Harvard University who has repeatedly suggested that Cruz's eligibility is not a "settled" legal matter and could ultimately disqualify him from taking the oath of office.
