A federal appeals court says a gay couple's lawsuit seeking damages from a Kentucky county clerk who refused to issue them a marriage license can proceed.

Rowan County Clerk Kim Davis refused to issue a marriage license to David Ermold and David Moore in 2015 because she said it violated her religious beliefs. Ermold and Moore sued, along with several other couples. Davis lost, and spent five days in jail for refusing to follow a court order.

The state legislature passed a law that removed county clerks' names from licenses. A district judge ruled this satisfied Ermold and Moore's lawsuit and dismissed the case. But they appealed, saying they wanted Davis to pay damages.

A federal appeals court ruled Tuesday the case could continue.

As has been said - it is not "equality" or "respect" the homosexual agenda wants and demands - it is to PUNISH EXCEEDINGLY anyone who does not embrace their behavior, condone it and participate in it.

Not getting a fictional government document didn't harm them one bit

If I recall correctly the gay couple didn't live in that county. They deliberately sought her out.

What damages indeed?
Did one of them die and the other fail to inherit?
Lose standing in Probate Court?
Cause them (out of moral consideration) to have to delay consummating the 'marriage'? (Okay, that one was sarcasm).

Unless they can show some pecuniary damage I would be disinclined to even hear the suit.

I don't know what they hope to get out of her. She's a county clerk and earns maybe $60,000 per year if she's lucky. This is all about punishing her.

Exactly. It is a vindictive act. They, like so many others of their ilk, could have gone elsewhere, but they targeted her out of hatred for her professed beliefs.
