ATF Reverses Policy on Pistol Stabilizing Braces

In a move that demonstrates why electing a Republican to the White House was a wise decision, the Bureau of Alcohol, Tobacco, Firearms and Explosives has essentially reversed a 2015 ruling that made it a felony for gun owners to shoulder their pistol braces.

The Washington Free Beacon explained that two years ago the ATF submitted a widely panned open letter stating that if a shooter were to press a brace to his or her shoulder while firing a pistol, it would constitute a “redesign” of the gun into a short-barrel rifle. And this “redesign” would be classified as a felony.

The ruling was based on the classification of pistols as “(f)irearms with rifled barrels under 16 inches that are otherwise functionally or aesthetically similar to short-barrel rifles but lack a stock designed to be pressed against the shoulder while firing,” according to the Free Beacon.

By adding a shoulder brace, firearm owners were transforming their pistols into rifles, the ATF basically argued...

In a news brief published Tuesday, the gun manufacturer SB Tactical, the originator of what’s known as the “pistol stabilizing brace,” revealed that it recently received a letter from the ATF stating that the 2015 ruling has officially been reversed.

“To the extent the January 2015 open letter implied … that incidental, sporadic or situational ‘use’ of an arm-brace (in its original approved configuration) equipped firearm from a firing position at or near the shoulder was sufficient to constitute ‘redesign,’ such interpretations are incorrect,” the ATF reportedly wrote.
