South Carolina Republican Rep. Trey Gowdy, a former federal prosecutor, took apart the 9th Circuit Court of Appeals ruling that blocked President Donald Trump’s immigration pause Thursday night.

Gowdy said in a statement that no one should be surprised with the ruling that came from the court and that the 9th Circuit “has a well-earned reputation for being presumptively reversible. Unlike the district court order, there is at least a court opinion which can be evaluated.”

Gowdy went on to say, “Of particular interest is the 9th Circuit Court of Appeal’s suggestion that even those unlawfully present in the country have certain due process rights with respect to immigration. The Court cites Zadvydas v. Davis, 533 U.S. 678, 695 (2001) for the proposition that even aliens who have committed and been convicted of certain crimes while in the U.S. unlawfully may have due process rights with respect to travel to or from the United States. In addition, the Court ventures curiously into its own role in reviewing a President’s national security conclusions.”

The rules are clearly laid out for immigration (albeit complicated).  Any foreign can apply and go through the process.  Many will not make it.

And you claim they can't.

You said "rights", the definition of which is clearly delineated in the founding documents.

You say they have right, presumably laid out in statutory law, to come here. Thats incorrect.

Once the US issues a visa to someone from a foreign country they aquire limited due process rights.

One of those rights would be not to have your visa cancelled with no advanced notice barring exceptional circumstances that the government must prove.

I really want to see the law stating that. Or anything remotely close to it since visas/green cards can be revoked for any reason at any time. By the executive that has ALL constitutional authority to do so.

Visas have NOT been cancelled. Reentry has been suspended, pending resolution of vetting for national security purposes.

Every President has made use of suspensions, deferrals of visas, reentry provisions, for decades.

The law cited to give "Plenary" authority to the Potus dates from 1952.  Plenary means "absolute."

Just stating law as it stands and has been interrupted by the Court.

Folks can  live in the fantasy that they know how the Courts should rule based on their preconceived notions but the Courts are and should be slow adapters, lagging the public by a generation or two.


The law and as it has has been interpreted by the SC for at least 100 years gives immigrants holding valid visa's limited due process rights. PERIOD

If trump was not such an idiot  this could and my view should have been implemented easily..but there is a vocal minority that can only see my way or the highway despite legal president.. :shrug:
