The problem I have with it can be boiled down to three words:   "Lowest Common Denominator."

A Federal definition of "moral" would be set by the definition that can pass muster everywhere.  Ultimately this would mean the definition of "obscene" in Iowa would be set by the desires of people in Los Angeles and San Francisco.

I foresee difficulty..

So, people in Iowa MUST put up with the mores of SanFranSicko instead? The old mantra, 'If you don't like it, turn the channel', flat doesn't work anymore. It has become ubiquitous.

And I might point of that obscenity standards were strictly enforced over the airways for many years - And we were better for it.

Quote
Edited to add:   I watched a showing of "Blazing Saddles" on a standard tier cable channel the other day.  "Shit" and "bleep" was allowed, "bleep" was not.

Oh, the horror! you'd have to painfully, heart-wrenchingly, blanched-facedly sit through 'bleep' and 'bleep', and 'bleep'. and try to figure out what they said.

How can we possibly wish it upon you?

The best way to be able to define moral standards is to drop the political correctness and stop protecting  the protected classes.

Apparently it is....   **nononono*

Don't get me wrong, I can be every bit as coarse as the next guy... I once smacked my thumb with a 3lb (yes you read that right) anvil hammer, and I couldn't quit cussin a streak for three days. Try to get a mule to go where it doesn't want to, and you will find out quickly why muleskinners are so infamous for their language.

But there has to be a way to have a good clean place to raise up our children - a place that doesn't leave good womenfolk offended. All of that used to happen when the women and kids weren't around, and was only wide-open in the bawdy houses across the tracks. Now the red-light district is everywhere...

Just go back to some basic things.

No shirt No shoes No service

We don't serve your kind here.

Get a room.

If you put your crap on front street and get your ass kicked you deserve it.

First of all, we are not talking about Japan.  They can have their own standards of obscenity, so your bringing them up (again) is not really germane to American law.

Also, we are not "making it a federal issue."  There have been mutually agreed upon standards in the past until the left began eroding them.

As a conservative, I would prefer this to be a state issue, but the internet makes that difficult.

Let me ask you this........ can we both agree that showing a child being raped by an adult male on TV is too obscene for everyone?  Is that a standard we can all agree on?

I'd agree.

My argument is that it'll never be a light hand, but a heavy one.  For the government always seeks to justify it's own existence.  Which means more and more expansion.

At the same time, that's child rape, which is a crime.  The issue is obscenity, which is usually between two consenting adults.

I wondering how one can define obscenity?

Obscenity.
If a political party does not have its foundation in the determination to advance a cause that is right and that is moral, then it is not a political party; it is merely a conspiracy to seize power.

-Dwight Eisenhower-

"The [U.S.] Constitution is a limitation on the government, not on private individuals ... it does not prescribe the conduct of private individuals, only the conduct of the government ... it is not a charter for government power, but a charter of the citizen's protection against the government."

Obscenity.

One of my favorites.

It always struck me that Obama was scolding Michelles buttcrack for gobbling up her action pants.

There is such a thing as "community standards"

There is a new "cannibal" type movie called "Raw", what if some place in Kansas or North Dakota or anywhere say, some movie, doesn't have to be raw, doesn't meet our community standards.

https://www.yahoo.com/movies/raw-red-band-trailer-the-horror-movie-that-made-people-pass-out-in-toronto-nsfw-185109288.html

There are decency laws, things such as that. The court could ultimately swing back in some of its decisions.

The article indicated Hatch usually asks these questions and really, any AG should indicate they'd enforce the law; it would just depend on the situation.

We might not want larger government as was brought up but certainly, there is a threshold to virtually everyone's tolerance of obscenity.

On balance, I'm going along with this view in this conversation.  Hatch does always ask these questions, and, come to think of it, it's expected of him.  I think Sessions did it as well as can be expected.

Apparently Orrin Hatch thinks it's a good idea.  Makes you wonder whose side he's on.

@Cyber Liberty

He seems to be firmly on the side of senility.

A few points:

1)
Quote
In October 2015, Sessions also cited bogus statistics that had been put forth by a leader of the Italian far-right to malign refugees as “economic migrants.”

Wow, nice objective article there huh?

2) Look, I can forgive Trump for his past transgressions and have, but let's face it, how the hell can and will a President who has talked about grabbing women by their "bleep", has talked frankly about sex and his love for sex, and has a wife who not only posed nude but was in soft-core porn have any credibility with "anti-obscenity laws"?

I agree. After nearly 4 decades on oil rigs, I can deliver a dressing down that could make an old-school Senior Master Chief blush. There is a time and a place for everything, but it isn't everywhere, heck, it isn't even there any more (you can get sued for that "hostile work environment", even if you're chewing them out about being unsafe).

If that environment has become that subdued, why are we allowing all that on the streets and in our living rooms when we aren't even allowed to say it?

My theory is we have all that going on in the streets and living rooms because of the subdued environment.  JMHO.

You may be right. If it wasn't a 'hate crime' to deliver a butt chewing, they'd likely move along.

There would be a lot more butt-chewing and a lot less jamming caps in their butts.

What you are saying is that there is a right time and place for everything. Many liberals believe the right time and place is everywhere and all the time.

That's right. I grew up tipping my hat to the ladies, putting your shirt back on if they were present, pleasant conversation with folks, and the idea that if you can't say it in front of your Gramma, it ain't worth sayin...

And then on the weekend, wander on down to the Wild Horse, where the band was loud, you could kick up your heels without very much discretion, really go on a tear, and the hoochie mammas thought it all in fun. Two wholly separated worlds.

The thing is, sometime in your late twenties or so, you get married to a good girl and your youth starts rubbing off, you settle down and start having babies, and you realize all that snorting and kicking up your heels ain't the way to go... And what with them children and all, you want to go back to Mayberry RFD... That pleasant, polite place... but nowadays, Mayberry's gone.  They mowed it over and put up a casino and a strip joint. *shakes head*
