It's still racism, even if it's not actionable discrimination (i.e., even if nothing can be done about it).  The hypocrisy is the speaker's belief that by definition he cannot be racist because he ain't white.  That is an ugly, insidious falsehood that, unfortunately, has become orthodoxy in modern American thought.
