Government seeks 'Serial' podcast interviews in Bergdahl case

A filmmaker who interviewed Army Sgt. Bowe Bergdahl for a popular podcast may be asked to turn over the unedited recordings of those interviews to the government, according to a preemptive lawsuit filed by the filmmaker’s attorneys.

“This case is brought to protect and defend plaintiffs’ constitutional right to communicate important stories about matters of immense public concern,” the lawsuit says. “Without this court’s protection, plaintiffs – and specifically [Mark] Boal – will be forced to provide a military prosecutor in North Carolina with unpublished materials and confidential information or face contempt charges.”

Bergdahl will face court-martial in February for walking off from his post in Afghanistan in June 2009, when he was subsequently captured by the Taliban and held until May 2014 prisoner swap.
