A modest proposal for who should be Scalia's replacement

I suspect the Obama admin monitors this site both for brilliant insights and signs of insurrection, so I have what I think is a great idea for what Zero should do about the current vacancy on the SC.

Step 1: He waits until Congress is in recess.

Step 2: He then resigns the Presidency.

Step 3: Biden is swiftly sworn in as his replacement.

Step 4: Biden then appoints Obama as Scalia's replacement. After all, as we all know, Obama is an expert when it comes to the Constitution. He would be perfect.

Only downside I can see here is that Obama may not take the appointment because he can't be Chief Justice and for him being secondary to anyone may be a deal breaker. Unless, of course, Roberts could be persuaded to vacate the office in favor of Obama.

Yeah, I like it.

SCOTUS would be too much work with none of the perks. I doubt he would take it.

Yes, a justice generally is expected to show up for work. That might be a problem.
