DES MOINES – “Today I was shown a piece of literature from the Cruz for President campaign that misrepresents the role of my office, and worse, misrepresents Iowa election law. Accusing citizens of Iowa of a “voting violation” based on Iowa Caucus participation, or lack thereof, is false representation of an official act. There is no such thing as an election violation related to frequency of voting. Any insinuation or statement to the contrary is wrong and I believe it is not in keeping in the spirit of the Iowa Caucuses.

Additionally, the Iowa Secretary of State’s Office never “grades” voters. Nor does the Secretary of State maintain records related to Iowa Caucus participation. Caucuses are organized and directed by the state political parties, not the Secretary of State, nor local elections officials. Also, the Iowa Secretary of State does not “distribute” voter records. Interestingly, this may actually be a  case of election misconduct in Iowa.

39A.2  ELECTION MISCONDUCT IN THE FIRST DEGREE.
         1.  A person commits the crime of election misconduct in the first
      degree if the person willfully commits any of the following acts:

         a.  Registration fraud.
         (1)  Produces, procures, submits, or accepts a voter registration
      application that is known by the person to be materially false,
      fictitious, forged, or fraudulent.
         (2)  Falsely swears to an oath required pursuant to section
      48A.7A.
         b.  Vote fraud.
         (1)  Destroys, delivers, or handles an application for a ballot or
      an absentee ballot with the intent of interfering with the voter's
      right to vote.
         (2)  Produces, procures, submits, or accepts a ballot or an
      absentee ballot, or produces, procures, casts, accepts, or tabulates
      a ballot that is known by the person to be materially false,
      fictitious, forged, or fraudulent.
         (3)  Votes or attempts to vote more than once at the same
      election, or votes or attempts to vote at an election knowing oneself
      not to be qualified.
         (4)  Makes a false or untrue statement in an application for an
      absentee ballot or makes or signs a false certification or affidavit
      in connection with an absentee ballot.
         (5)  Otherwise deprives, defrauds, or attempts to deprive or
      defraud the citizens of this state of a fair and impartially
      conducted election process.
         c.  Duress.  Intimidates, threatens, or coerces, or attempts
      to intimidate, threaten, or coerce, a person to do or to refrain from
      doing any of the following
:
         (1)  To register to vote, to vote, or to attempt to register to
      vote.
         (2)  To urge or aid a person to register to vote, to vote, or to
      attempt to register to vote.
         (3)  To sign a petition nominating a candidate for public office
      or a petition requesting an election for which a petition may legally
      be submitted.
         (4)  To exercise a right under chapters 39 through 53.

No violation has been committed. The mailer didn't cite any law or ordinance or imply such.

UPDATE 5:00am:  It looks like Howie might have found the trail, via a professor in Northern Iowa named Christopher Larimer.  Describing a previous stunt like this in Alaska.  As outlined in a 2014 PBS article:

    […]  “Why would they think that shaming would make people comply?”

    Because, well, it does. That’s according to Chris Larimer, associate professor of political science at the University of Northern Iowa. And he’s done the research to prove it.

    “We found that when you make people aware of the norm of voting and that somebody else is going to observe whether or not you vote, people are more likely then to vote,” he said.

    The letter from the so-called Alaska State Voter Project is nearly identical, word for word, to one that Larimer and other researchers tested in Michigan, right down to the typography and punctuation. In that 2006 research, Larimer and colleagues sent voters one of four different letters.

    The softest message just urged people to do their civic duty and vote. The most aggressive letter matched the Alaska mailer. It included the addressee’s voting history as well as those of their neighbors, and contained something of a threat by promising a follow-up letter to show the results of the upcoming election.

That emboldened segment describes the current Cruz Campaign mailer 100%.  Also, Chris Larimer is noted in this recent Texas Tribune article about the controversial debate:

The statute (above) makes no mention of how the act of "intimidation" is performed.

Rest assured, no one is going to be charged with any violations here.  But it is worth pointing out that it is a violation as described in the State of Iowa's "Election Misconduct and Penalties Act."

The test is how Iowa voters feel about the invasion of their privacy, manipulation, intended threats, etc.

Forget the legal fine points. Cruz has displayed awful judgment repeatedly.

If Republicans really want to see the impact of voter fraud, just wait until November 2016 when millions of illegal aliens vote for whoever replaces Hillary Clinton after she goes to prison, or if she doesn't then Hillary Clinton.
