Lawyer Challenging Ted Cruz Eligibility Was Suspended From Practice of Law

A birther lawsuit challenging Ted Cruz's eligibility was filed today in federal court in Texas.  I had previously written that such a lawsuit challenging the eligibility would most certainly lack standing and would be frivolous.  The lawyer who filed the complaint, Newton B. Schwartz, Sr., had been suspended from the practice of law by two separate states for disciplinary infractions.

According to the detailed disciplinary ruling against Schwartz in Louisiana, he engaged in legal matters in Louisiana but was never admitted to practice law in the state and never sought temporary admission. (You can read the lengthy disciplinary case against Schwartz here).

The Louisiana Office of Disciplinary Counsel filed formal charges against Schwartz on July 19, 2011.  In February 2014, Schwartz was suspended from attempting to practice law in Louisiana.

Louisiana disciplinary counsel alleged that Schwartz had a swarm of ethical violations.  They include "engaging in conduct involving dishonesty, fraud, deceit or misrepresentation."

Schwartz was also barred from practicing in Pennsylvania.  According to the Pennsylvania Supreme Court, Schwartz consented to his suspension from the practice of law in Pennsylvania.

Schwartz remains a member of the Texas Bar.

So Schwartz was debarred in two states but can still practice in Texas?

Did you know a prisoner in a federal penitentiary can still file a lawsuit?

Schwartz is a nut and not unknown in these parts. He is a big donor and bundler for not just Democrats, but extreme left groups like the American Association for Justice and Political Action which is a Communist front.  He is a character, kind of the Scrappy Holmes of Houston.

???  The lawyer was suspended in two different states.  He is trying to bring suit against a U.S. Senator who is also running for the president of the United States...good look with that one.

He's not representing a client so it probably doesn't matter that he was suspended or barred from practicing in some states.

But it probably matters that he lacks ANY standing to bring this suit.

Yes, absolutely. Shooting the messenger is a completely fair argument when the messenger creates the message (in this case the suit). It reflects on the judgement and biases of the messenger as well as the merits of what the message is.

Were he and Bile Clinton in practice together?  Both have lost their eligibility at one time or another for corruption. :whistle:
