... Rubenstein, a 70-year-old civil rights lawyer and longtime nemesis of the NYPD, contends he had consensual sex with the woman — after her friend left — at his $7 million penthouse pad.
And when they woke up the next morning, a source close to Rubenstein claims, they had sex again.
Police, however, are investigating the woman's allegations that Rubenstein took advantage of her drunken state when they returned to his apartment from the Rev. Al Sharpton’s 60th birthday bash Wednesday. She told cops she woke up from a drunken haze to find Rubenstein violating her.
Investigators are treating the case as a possible third-degree rape, meaning the alleged victim was incapable of giving consent, sources said.
Security video police obtained from the party, the entrance to Rubenstein’s building, and possibly by the elevator, confirm she was “out of it” the night of the attack, a source said.
There was no comment from the accuser, who is a business executive and high-ranking official at Sharpton’s National Action Network. ...
