Obamacare "doesn't even exist" except in President Barack Obama's head, Washington Post columnist Charles Krauthammer said, because the president is playing loosely with the law.
"It's whatever he thinks," said Krauthammer, appearing on Fox News' "Special Report with Bret Baier" Wednesday. "He wakes up in the morning and decides what the law is going to be."
The conservative columnist and Fox News contributor said "that's not the way it's supposed to work."
"Remember how Democrats were complaining that when Republicans were trying to overturn Obamacare, it was somehow unpatriotic because it was an attack on the law of the land?" Krauthammer said. "The law of the land doesn't even exist. It exists in Obama's head."
He said an editorial in The Washington Post, "not exactly a right-wing rag," slammed Obama for changing the law.
The editorial, Krauthammer said, complained that "Obama has really overstepped the lines arbitrarily, changing the law, and usurp what Congress is supposed to do."
The Obama administration Monday delayed another part of Obamacare, saying medium-size businesses won't face a tax penalty until 2016 for not providing workers with health insurance coverage, refueling Republican criticism that President Barack Obama's signature healthcare law is a "train wreck" and "jobs killer."
The follows last July's delay until 2015 for the so-called employer mandate component of the Affordable Care Act.
For most individuals, there's a threatened tax penalty for not having healthcare coverage in 2014. But the final regulations released will allow businesses with between 50 and 99 employees that are not already offering coverage to avoid a penalty until 2016.
