The Texas Dream Act was enacted in 2001, granting illegal aliens in-state tuition benefits.

A federal appellate court has upheld an agreement between Texas and the Trump administration ending in-state tuition for illegal aliens in compliance with federal law.

The Texas Dream Act, enacted in 2001, formerly allowed qualifying illegal alien students to pay in-state tuition rates at public colleges and universities.

In June 2025, the U.S. Department of Justice sued the State of Texas, arguing that federal law preempted the Texas Dream Act.

According to the suit, federal law preempts any state rules that grant illegal aliens benefits not afforded to all U.S. citizens. The Texas Dream Act did this because U.S. citizens from outside the state were forced to pay higher rates than the qualifying aliens.

A federal appeals court ruled that Texas cannot give in-state tuition to undocumented students.

In a decision handed down Thursday, the Fifth Circuit Court of Appeals ruled that a 25-year-old Texas law allowing these discounts directly conflicts with federal law. The court pointed to a federal statute that says states can’t give higher education benefits to undocumented immigrants based on where they live unless they offer those same perks to all U.S. citizens, regardless of what state they’re from.

Under the Texas rules, out-of-state American citizens were being charged much higher tuition rates than undocumented students living in Texas, which the court said is illegal.

It's not right that a kid from New Mexico should have to pay more than an illegal alien to attend Texas A&M!
I don’t owe tolerance to people who disagree with my existence.

I mean yeah, they crossed a border too didn't they? Oh yeah, just not the right kind of border.

I'd like to see a similar lawsuit filed here in Arizona, we have the same stupid law!
