Supreme Court rules on Trump tariffs in major test of executive branch powers
The Supreme Court ruled on Trump's use of an emergency law to invoke steep tariffs on most US trading partners

The Supreme Court on Friday blocked President Donald Trump’s use of an emergency law to unilaterally impose sweeping tariffs on most U.S. trading partners, delivering a blow to the president in a case centered on one of his signature economic policies — one he characterized as "life or death" for the U.S. economy.

In a 6-3 decision, the justices invalidated Trump's tariffs.

The Supreme Court heard oral arguments in November in the case, which centered on Trump’s use of the International Emergency Economic Powers Act (IEEPA) to enact his "Liberation Day" tariffs on most countries, including a 10% global tariff and a set of higher, so-called "reciprocal" tariffs on certain nations.

In April, Trump declared the U.S. trade deficit a "national emergency," and lawyers for the administration have cited that declaration as the legal basis for invoking IEEPA, which allows the president to respond to "unusual and extraordinary threats" when a national emergency has been declared.

The high court agreed to take up the case last fall after lower courts, including the U.S. Court of International Trade (CIT) and the U.S. Court of Appeals for the Federal Circuit, blocked Trump’s attempt to use IEEPA to enact import duties.

Lower courts pressed the Justice Department to explain why Trump invoked IEEPA when other, more narrowly tailored statutes enacted by Congress more specifically address tariffs — including laws that cap tariffs at certain levels or set timeframes subject to congressional review.

The law authorizes the president to "regulate … importation" during a declared national emergency, but it does not mention the word "tariffs" — an omission that was at the heart of the hours-long arguments before the high court in November.

During oral arguments in November, justices pressed administration lawyers on whether IEEPA applies to tariffs or taxation powers and what guardrails — if any — would limit the executive branch should the high court rule in Trump’s favor.

In arguments, lawyers for the administration told justices that IEEPA allows a president to "regulate" "importation" of goods, which they said is the practical equivalent of a tariff.

But justices, including Trump’s conservative appointees, appeared skeptical, pressing the administration on whether there has "ever been another instance in which a statute has used that language to confer the power" Trump seeks.

Other conservative justices questioned whether an "economic equivalent" to tariffs — such as sanctions, embargoes, licenses and quotas — could be used by the president under the law.

Lawyers for the Trump administration have argued in lower courts that the IEEPA allows a president to act in response to "unusual and extraordinary threats" and in cases where a national emergency has been declared.

On the issue of refunds - this from J. Kavanaugh dissent:

... the Court’s decision is likely to generate other serious practical consequences in the near term. One issue will be refunds. Refunds of billions of dollars would have significant consequences for the U. S. Treasury. The Court says nothing today about whether, and if so how, the Government should go about returning the billions of dollars that it has collected from importers. But that process is likely to be a “mess,” as was acknowledged at oral argument.

BREAKING: In a confused decision, a divided majority of the Supreme  Court found that the congressional statue authorizing a president to "regulate importation" could allow President Trump to completely shut down imports but not impose the lesser penalty of tariffs. As Justice Kavanaugh observes in a sensible dissent:
"As (the majority) interpret(s) the statute, the President could, for example, block all imports from China but cannot order even a $1 tariff on goods imported from China."
The decision is an immediate loss for @RealDonaldTrump
 but also places our national security at risk in that it undermines a useful foreign policy tool for a president in national emergencies.

In other words, SCOTUS saved the president from himself.  People are unhappy with their bills, despite whatever topline numbers are being published.  If prices ease by the summer then it may raise Trump's economic approval closer to 50%.

SCOTUS only considered tariffs issued under the IEEPA & struck those down.

President Trump primarily relied on IEEPA for sanctions & emergency-based restrictions. Numerous major tariffs were imposed under standard trade statutes, not emergency powers, so many remain in effect.

One major takeaway from SCOTUS' ruling on Trump Tariffs: It will only further incentivize Congress' dereliction of duty.

If Congress opposes a president's policy it should use its powers to constrain him.

We are operating today as if there are only two branches of government that deal with any matters of consequence.

The Supreme Court majority today issued a very messy and problematic decision.  See below.  The fact is the majority agreed on an outcome but not so much on the reasoning for the outcome.  Furthermore, it struck tariffs under a single statute, yet created chaos or, actually, left it to the president to decide if and/or how to treat the revenue those tariffs already created for the federal Treasury. 

The majority had a problem, which I said it would, should the Court move in this direction: tariffs are more than indirect taxes; they do, in fact, impact foreign affairs and national security matters and have been used for those specific purposes.  Therefore, the question is not who has the power to tax per se, but a more complicated question about where the separation of powers is.  The majority, apparently, chose to duck the question and stick with the indirect tax characterization and focus on a single statute, which is outrageous.  It could not figure out how to bifurcate the Congress's power of the purse from the President's foreign policy powers, so it redefined the issue to reach the outcome -- and even then, they argued over the rationale.

So, we are left with even a worse ambiguity.  1. If only Congress can raise taxes, even indirectly, then how does the Court justify the entire regulatory state in the executive branch that raises indirect taxes hourly?  Congress may have delegated that power to the bureaucracy, but it does not have the power to delegate legislative power and taxation.  This goes back as far as John Locke's Second Treatise on Government.  Yet the Court is okay with that since it is okay with the massive welfare state. 2.  Putting aside the specific statute, it appears the President is still free to raise or cut tariffs under other statutes, but that will no doubt be challenged as well.  The Court succeeded only in creating confusion going forward.  3. Since the Court foolishly decided to get involved in this matter, even though the majority states it is not getting involved in policy, it has gotten into policy, and it has not drawn a clear line on separation of powers because it cannot, and it created a terrible mess -- both legally and economically.

SCOTUS got it right, in my view. Three points:

1) Justice Gorsuch’s exchange in oral arguments was so key to me. He asked if a future POTUS could use this precedent to unilaterally declare a “climate emergency” and impose policies he or she wanted as a result. The admin’s lawyer said probably yes. NO THANK YOU! 🚩

2) SCOTUS isn’t so much slapping down Trump as it is *once again* telling Congress to do its job. If we want to use tariffs this way (separate debate, I’m skeptical), we can pass laws constitutionally. Way too much reliance on the executive and judicial branches to do things they won’t/can’t do with the authority they actually have.

1) This ruling deals another blow to the Left’s cynical and dangerous delegitimization campaign against SCOTUS. They push destructive schemes like court packing because they are annoyed that they don’t get all the outcomes they want from the current Court. They lie and pretend this Court just prostrates itself in front of Trump and bends to his will. Not so, including on this big one.

The Supreme Court defended the Constitution by rejecting the use of “emergency” powers to impose taxes. Tariffs are taxes and the power to declare them belongs to the Congress. This goes beyond this case. No future administration, including a socialist one, can use “emergency” powers to get around Congress and tax by decree.

TARIFFS are a TAX.
CONGRESS granted the “Power To lay and collect Taxes, Duties, Imposts and Excises.” CONSTITUTION ARTICLE I, SECTION 8
The word TAX does NOT appear ANYWHERE in the International Emergency Economic Powers Act (IEEPA).
Power to tax via this statute not granted to the executive branch.

2) SCOTUS isn’t so much slapping down Trump as it is *once again* telling Congress to do its job. If we want to use tariffs this way (separate debate, I’m skeptical), we can pass laws constitutionally. Way too much reliance on the executive and judicial branches to do things they won’t/can’t do with the authority they actually have.

For a court that should ground itself in precedent, they seem to forget that this was the primary mode of sovereign revenue collection the first 100 or so years of this country. 

And now can't be used in a variable means to level the playing field in international trade?  Even the greatest fiscal POTUS in history (Coolidge) knew it's importance as a tool.   

SCOTUS screws us again.

Don't expect any Congressional Republican to drop a testacle to write legislation.  They are beholden to their Globalist Chamber of Commerce Pirate Equity Vulture Capital Kleptocratic Wall Street Oligarch donors and king makers.

They are letting Trump take all the risk so they don't have to risk incurring a papercut while writing legislation.  Boo boos hurt.  8888crybaby

The Supreme Court defended the Constitution by rejecting the use of “emergency” powers to impose taxes. Tariffs are taxes and the power to declare them belongs to the Congress. This goes beyond this case. No future administration, including a socialist one, can use “emergency” powers to get around Congress and tax by decree.

Paul's right.  And I've said all along that Trump's tariff's were unconstitutional and would come back to bite.  So here we are...

Just one more example of where SCOTUS is out of control.  They have gone out of their way to impede the executive branch of government.  This action has but one goal in my mind.  TO MAKE ATTORNEYS A SH*T TON  OF MONEY!  GOT TO PROTECT THE BIGGEST UNION IN THE USA WHILE SCREWING OVER THE US CITIZENRY!!!

SCOTUS and their rulings has resulted in mass genocide, with 70 million unborn babies being murdered.  At no time should a body of stinking lawyers, now judges, decide that we should as a nation practice mass genocide.  The evil that persists with this court knows no bounds.

Trump should have his team put a piece of legislation together and shove it down the throats of the do nothing Congress, and sell it to the American people, to restrict the powers of SCOTUS.  These people(SCOTUS) have no business making these decisions.
