It is a popular fallacy that freedom of the press enshrined in the First Amendment is absolute. It is not and never has been.

The recent arrest of podcaster Don Lemon on federal criminal charges that he willingly joined a mob of anti-ICE protesters who stormed a St. Paul, Minnesota church during Sunday services will inevitably test well-established limits on press freedoms.

Journalists, however defined, cannot, without legal consequences engage in incitement, defamation, obscenity, threatened violence, national security breaches, and the commission of crimes. 

Calling yourself a "journalist" or claiming that you are simply "committing journalism," as Lemon has done, is not a defense. It is your behavior that the law examines. Both words and actions can reveal your intent.

This is why Lemon has found himself in criminal jeopardy. His own digital videos seem to incriminate him. 

In footage that Lemon posted online, it appears that he was not merely an observer recording the illegal protest inside the church, which would be a typical role of a reporter. Instead, he seemed to be an active participant who embedded himself with the mob and joined their cause in harassing and tormenting the parishioners.

Don Lemon blows a kiss to LA Mayor Bass during initial appearance.    Details from Fox Producer Lee Ross.

Don Lemon was the last person to enter the courtroom.  Everyone. Including. The judge was already seated.  He was escorted in without restraint by us Marshall and sat at the defense table next to his lawyer.

The only times Lemon spoke were when he was asked a series of questions by the judge on whether he understood the charges against him and his rights in the case.  To all of the questions he offered in a clear strong voice a variation of “yes” “yes, your honor” “yes, ma’am”.

Lemon was wearing a tan suit with a matching tan collarless shirt.  I saw him wave and blow a kiss to Mayor bass who was seated in the first row of public benches right behind the defense table.  I also saw lemon offer several winks and an easy smile to this area. Perhaps to his husband who was seated in the second row behind bass. 

Otherwise. Lemon was fully attentive to the proceedings.

Former CNN host Don Lemon was released from custody without bail Friday after his court appearance in Los Angeles.

"I've spent my entire career covering the news. I will not stop now," Lemon told reporters outside the courthouse. "There is no more important time than right now, this very moment, for a free and independent media that shines a light on the truth and holds those accountable. And I will not stop now. I will not stop ever.

"Last night, the DOJ sent a team of federal agents to arrest me in the middle of the night for something that I've been doing for the last 30 years. And that is covering the news. The First Amendment of the Constitution protects that work for me and for countless other journalists who do what I do. I stand with all of them, and I will not be silenced. I look forward to my day in court."

Lemon, wearing a tan suit and a tan collarless shirt, was escorted into the courtroom without restraints. Showing support for Lemon in the courtroom was his husband and Democratic LA Mayor Karen Bass.

Everyone in the Congregation, the minister, and even the children should bring civil suit under 18 USC Sec 241 for conspiracy to deprive them of their Civil Rights and seek punitive damages from all of those involved in the disruption. Bankrupt them.

Yep, I tire of seeing leftist escape justice with their peers often not caring if they do anything. From OJ Simpson on, I am starting to doubt "justice from peers" when it comes to certain sectors of society.

I want to see a jury of white (unlike his husband or whatever he is) heterosexual males that go hunting 3X or more times a year after church.
