Attorneys for Tyler James Robinson have formally objected to prosecutors introducing and publicly displaying a graphic video of the fatal shooting of Charlie Kirk at an upcoming pretrial hearing, arguing the footage is irrelevant to the legal issue before the court and risks severely prejudicing potential jurors.

In a nine-page filing submitted January 27, Robinson’s defense team objected to the State of Utah’s proposed close-up color video with audio that captures the moments before, during, and after Kirk was shot. The objection was filed ahead of a February 3 evidentiary hearing on Robinson’s motion to disqualify the Utah County Attorney’s Office from prosecuting the case due to an alleged conflict of interest.

The defense argues the hearing has nothing to do with the cause of Kirk’s death or Robinson’s guilt or innocence, but instead focuses narrowly on whether a family member of a prosecutor personally witnessed events at Utah Valley University on September 10, 2025, creating an actual or apparent conflict of interest.

According to the defense, prosecutors have already submitted still photographs and diagrams showing Kirk’s location and the proximity of witnesses, which Robinson does not oppose. Those materials, attorneys argue, are sufficient to address the limited factual questions relevant to the disqualification motion.

Robinson’s lawyers claim the video has no probative value in determining whether the prosecution team should be disqualified. They also argue that even if the court finds minimal relevance, the footage should be excluded under Rule 403 due to the danger of unfair prejudice.

The filing describes it as “graphic and likely highly disturbing” and warns that if played in open court, the video could be immediately broadcast nationwide and internationally. Defense attorneys say such exposure would jeopardize Robinson’s constitutional right to a fair trial in what they note is a capital case.

A Friday motion filed by the defense team of Tyler Robinson, the man charged with assassinating Turning Point USA founder Charlie Kirk, revealed that the prosecution intends to call Robinson’s parents, as well as his transgender roommate with whom he had a romantic relationship, as witnesses in the preliminary hearing currently set for May. The defense is attempting to delay those proceedings.

The defense filing stated that counsel for the parties met on March 12 and spoke about discovery issues and evidence the state intends to present in May. The preliminary hearing is currently set to take place the week of May 18 through 22.

"Based upon the State’s representations at this meeting, the State intends to present discrete 'buckets’ of evidence through three identified law enforcement witnesses. This includes conclusory forensic DNA and ballistics reports authored by the FBI and the ATF, phone and social media data, testimony by law enforcement officials about the crime scene and search locations, and testimony by Mr. Robinson’s parents and roommate," the filing stated. ...

SALT LAKE CITY (AP) — Charlie Kirk’s widow and parents are expected this week in a Utah court where prosecutors seeking the death penalty will argue that the man charged with killing the conservative activist should stand trial for murder.

The five-day preliminary hearing that starts Monday will be the first time members of Kirk’s family are in the Utah courtroom with defendant Tyler Robinson. The hearing will be livestreamed.

Robinson turned himself in after the shooting. Prosecutors allege that he also sent a text message confession to his partner and left a note saying he had an opportunity to kill one of the nation’s leading conservative voices “and I’m going to take it.” ...

 Beginning Monday, the focus shifts to whether there is enough evidence for a trial and if the death penalty is warranted, said Paul Cassell, a University of Utah law professor and former federal judge.

Cassell said evidence made public to date in court filings suggests prosecutors have “an overwhelming case.”

“This seems like the proverbial slam dunk at this stage of the case, where the only issue is whether there is a sound basis for moving forward with a trial on the merits,” he said.

A death sentence is an option in Utah only when a crime has aggravating circumstances. Prosecutors will argue in Robinson’s case that Kirk’s shooting endangered others in attendance.  ...

It appears the prosecution has video from UVU showing Tyler Robinson approaching the campus, entering the building, reaching the roof, and taking the shot. We won’t know for sure until it goes to trial, but we do know UVU has cameras everywhere and that they provided the footage to investigators.
Going to be hard to refute that folks.
