Damn. That's going to be a tough one for the authorities. Not clear cut.
There is no question that the driver should not have tried to take off after having been told to get out of the vehicle. Bad mistake.
She backs up briefly and then pulls forward, with the agent only partially in her way, off to the driver side, but still potentially in danger - and that might be the key.
The officer pulls his service weapon and fires one shot through the windshield, driver side, and then two follow-up rounds.
It appears that the driver's intention may have been to continue turning down the road, potentially to get away... but there's no way to be certain, and the officer, with a fraction of a second to decide, did not take that risk.
