Utah judge issues pre-trial protective order for Charlie Kirk's widow, Erika Kirk

Utah Fourth Judicial District Court Judge Tony Graf on Tuesday granted a pre-trial protective order for Charlie Kirk’s widow, Erika Kirk.

The requested was filed by Utah County prosecutors.

"I have reviewed the pretrial protective order and will be issuing this pretrial protective order in favor of Erika Kirk," the judge said.

It is my express understanding that he had dozens of "stay" petitions thrown at him by a rolodex of lawyers.

Doesn’t work that way.  “Refusing to press charges” is inaccurate talk for “I won’t testify at the trial” and only works if the victims testimony would be crucial to the prosecution.

First, her testimony is not relevant to the acts charged, so she has no leverage there.   Second, there is more than enough other evidence, including the fascists own words, to prosecute him.

Did Jesus say the man beside him on the cross was wrongfully being put to death?... Did Jesus contradict him when the convict said he (himself) was rightfully being put to death (and Jesus did no wrong)?

Sorry, but if she does "forgive" the killer (especially if he has not heartfelt asked for forgiveness), I will be highly disappointed. Society demands to see justice, and though she had more skin in the game, all of us were affected. From kids at the event to kids shown the murder in classrooms by their demented teachers (and 10,000 other ways this affects all of us).

Oh, I can forgive him... And she can too. I have no hate for the man even now. I think he is horribly confused and hasn't thunk out his path.

But he has a bill to pay. And none of that has anything to to with forgiving him, if you can understand that.

My 'silly' suggestion in the personal plea for mercy from a firing squad was as much for the cameras...not for the actual success in the final outcome.

It could turn the focus of the post-execution revenge toward the government and not the MAGA crowd.

To everyone who thinks the text messages in TR’s charging document are a forgery, the prosecution is required to disclose every element of those text messages to the defense.  This includes all data, and must allow access to the devices themselves to extract data including metadata.  This data will disclose when and likely where the messages were sent and received.  If the charging document is forged, the police and the prosecutors are in big trouble.  Can metadata be tampered with?  Yes.  It can even be deleted entirely.  However you can’t mess with metadata without leaving evidence that it’s been messed with, and any data analyst the defense hires would know exactly what to look for.  Any evidence of tampered metadata would destroy the prosecution completely. 

Bottom line,  the text messages in the charging document are very likely real and accurate.

McVeigh targeted a Federal building and Federal employees which made it a Federal crime.

The genius of stochastic lone wolf terrorism is that is won't be prosecuted as terrorism as long as the targets are not Federal Property nor Federal employees, and there is no admissable proof of an interstate or international conspiracy.

The assassin's electronic footprint could be a vector for pursuing an interstate or international conspiracy charge if there is evidence to support it.

Also, if there is proof that he violated Federal firearms laws, that could be another vector for Federal prosecution.

McVeigh targeted a Federal building and Federal employees which made it a Federal crime.

The genius of stochastic lone wolf terrorism is that is won't be prosecuted as terrorism as long as the targets are not Federal Property nor Federal employees, and there is no admissable proof of an interstate or international conspiracy.

The assassin's electronic footprint could be a vector for pursuing an interstate or international conspiracy charge if there is evidence to support it.

Also, if there is proof that he violated Federal firearms laws, that could be another vector for Federal prosecution.

Just do like the Lib DoJ's do...charge it as a civil rights violation.
