Colorado AG Sues Sheriff’s Deputy Because He Assisted ICE [WATCH]

Colorado Attorney General Phil Weiser has filed a lawsuit against Mesa County Deputy Alexander Zwinck, accusing him of violating state law by allegedly cooperating with federal immigration authorities to detain a 19-year-old illegal alien.
 

Weiser announced the lawsuit Tuesday, stating that the deputy’s actions constituted unauthorized participation in federal civil immigration enforcement, which is prohibited under Colorado law.

“Colorado law is clear: it is illegal for local law enforcement to carry out federal civil immigration enforcement,” Weiser posted on social media.

“And in Colorado, we do not allow the federal government to commandeer local resources for their own agenda.”

First, I don't believe this is going to work well for the AG.

Second, that comment is another way of saying we don't cooperate with federal immigration law.

Third, that comment is likely to piss off Homan and Trump which will work quite poorly for Colorado.

Ultimately, I think the federal Supremacy Clause (in which local law enforcement officers can't be prosecuted for assisting federal law enforcement officers) will lead to a favorable ruling for the deputy, and that the stupid AG may get a legal precedent he may regret.

Colo use to be a nice place.  Prolly still is outside of your communist college towns and Denver.

A law suit instead of criminal charges? If the action is against the law, isn't that handled as a criminal matter?

Different standards for a 'conviction'. Criminal is beyond a reasonable doubt, civil is a preponderance of evidence. Civil may not cling so tightly to the letter of the law, either. The AG is stacking the deck.

The DOJ should provide the lawyers to defend people who help federal law enforcement making it a losing expensive proposition for those cities who try this.

One of my BIL’s grew up in Dove Creek Colorado, which may still be the pinto bean capitol of the world, it was a small little town where everybody tot drunk,  screwed everyone else, and then gossiped about it. Seems nice, I will say that it was some beautiful country I saw the one time I went hunting with him.

I see that too... But how the hell does the state AG go after a deputy like that? Might could go after the sheriff for it (the department, I mean), but go after a deputy, in the course of his duty? Isn't the deputy a technical extension of the Sheriff himself?

I think if the AG can't find a criminal charge, then he ain't got a leg to stand on.
