Judge orders release of Columbia activist Mahmoud Khalil from ICE detention

A federal judge in New Jersey on Friday ordered that Columbia University activist Mahmoud Khalil must be released from detention by Immigration and Customs Enforcement as his immigration proceedings play out.

During a hearing before U.S. District Judge Michael Farbiarz, Khalil's attorneys asked him to free Khalil from detention or transfer him to New Jersey. Farbiarz agreed, determining that Khalil is not a threat to the community, not a flight risk and that his detention has been "highly unusual."

Farbiarz denied the government's request to stay his decision. In his written order, Farbiarz said that "the Petitioner shall be released from immigration custody today." His bail conditions restrict his travel to New Jersey, New York, Michigan, Washington, D.C., and Louisiana, where he must attend all of his immigration proceedings.

Khalil is a green card holder who was detained by immigration agents in March and is currently being held in Louisiana. His wife Noor Abdalla was 8 months pregnant with their first child when he was first taken into custody, and gave birth to a baby boy in April. Immigration officials denied Khalil's request for temporary release to attend the birth.

"My husband was taken away from me in the middle of the night. It was one of the most terrifying times of my life. I don't think I've ever experienced anything scarier than that," Abdalla said in a March interview with  "CBS Sunday Morning."

Is this just a poorly constructed sentence or is he restricted to all of those places (which would mean traveling by air, because some of them are obviously not directly connected)?

Columbia protester Mahmoud Khalil freed from immigration detention

JENA, La. (AP) — Palestinian activist Mahmoud Khalil was released Friday from federal immigration detention, freed after 104 days by a judge’s ruling after becoming a symbol of President Donald Trump ’s clampdown on campus protests.

The former Columbia University graduate student left a federal facility in Louisiana on Friday. He is expected to head to New York to reunite with his U.S. citizen wife and infant son, born while Khalil was detained.

“Justice prevailed, but it’s very long overdue,” he said outside the facility in a remote part of Louisiana. “This shouldn’t have taken three months.”

The Trump administration is seeking to deport Khalil over his role in pro-Palestinian protests. He was detained on March 8 at his apartment building in Manhattan.

Khalil was released after U.S. District Judge Michael Farbiarz said it would be “highly, highly unusual” for the government to continue detaining a legal U.S. resident who was unlikely to flee and hadn’t been accused of any violence.

“Petitioner is not a flight risk, and the evidence presented is that he is not a danger to the community,” he said. “Period, full stop.”

Mahmoud Khalil arrives in NJ after being granted release... and vows to continue fight 'even if they kill me'

Columbia University graduate student and Palestinian activist Mahmoud Khalil has landed in New Jersey, telling reporters that he will continue to fight for his country 'even if they kill me.'

Khalil, 30, arrived at Newark Liberty International Airport on Saturday to an eruption of cheers after he was detained by Immigration and Customs Enforcement for over 100 days.

New York Representative Alexandria Ocasio-Cortez greeted him at the airport and stood by his side as he spoke to the press.

Khalil defiantly spoke, telling reporters: 'If they threaten me with detention, even if they would kill me, I would still speak up for Palestine.'

'I just want to go back and continue the work I was already doing, advocating for Palestinian rights, a speech that should actually be celebrated rather than punished.'

Ocasio-Cortez spoke at the conference to condemn the Trump administration for 'persecution based on political speech.'

She added that Khalil was unlawfully 'taken' and argued that federal officials acted illegally when detaining the activist.

Khalil, a lawful resident of the US, was granted release and freed on bail by a New Jersey federal judge on Friday.
