Elizabeth Warren: Congress Has to Take Tariff Authority Away from Trump

Pam Key 13 Apr 2025

Senator Elizabeth Warren (D-MA) said Sunday on CNN’s “State of the Union” that Congress had to take away the tariff authority from President Donald Trump.

Warren said, “It is a mistake to have the President of the United States out there just playing red light, green light and saying, oh, this morning I woke up and think the tariffs should be this big. Now, I think they should be this big; now, I think they should be somewhere else. And I got to say, saying, well, I will continue to make those decisions and I’m going to hold off on these tariffs for 90 days, that doesn’t put the economy in a better place. That doesn’t put investors in a better place.”

She added, “Congress has a job right now, and that is to step up and take this authority away from Donald Trump. He has proven how he will use it. But remember the statute that he’s now using starts with a declaration of emergency. And in that same statute, Congress has the responsibility to decide is it really an emergency or not? Are we really in an emergency with Belgium right now? Are we really in an emergency with South Korea? Congress can say no, there’s no emergency. It’s a resolution. And if we do that, it takes Donald Trump back to the trade as we had it before. Tariffs are then decided with Congress having an important say in it. That’s an important signal to the rest of the world. Right now it’s a no curbs on Donald Trump and that means chaos and corruption. We have an opportunity in Congress to vote that down and to say, no, we are going to use tariffs in a far more targeted way.”

Uh, actually, Congress does have the ability to remove the tariff power from the president - that is not an inherent power of the presidency, it is a power that was improvidently granted by Congress to the executive, and arguably stretched out of all reasonable proportion by No. 47.

Uh, I was responding to her claim that there were no "curbs" on Trump. If she understood the Constitution, she'd know that Congress - of which she is a member - could pass a law.

Fair enough; my apologies for jumping feet first into the middle.  You are absolutely correct that Congress is supposed to act, in part, as a check on the executive and, as you point out, if she wants to impose an additional restriction on Trump, then she'd better get her logrolling panties on (my characterization, sorry) and build up support in Congress to get such a law passed.

Oh, spare me the concern. You don’t care about the average Chinese worker — let’s be honest, if I end up paying $5,000 for an iPhone, that’s just less money I’ll have to spend elsewhere. But hey, thanks for pretending to care.

So excuse me for not wanting to shell out $50 for a basic T-shirt or $300 for sneakers. It’s my money, my choice. And let’s be real — even if manufacturing somehow comes back, it’s not like there’ll be some glorious return of jobs. Most of it will be automated. But sure, keep clinging to that 1950s fantasy.

And when those factories do open up again? I’m sure you’ll be first in line — ready for those 16-hour shifts, asking permission to go to the bathroom, and clocking in like it's your patriotic duty. Sounds like a dream, right? Knock yourself out.

Funny enough, it would be nice if Trump cooled it with the executive orders, and while Congress votes on the tariffs — you know, like the Constitution intended. But something tells me you don’t give a damn about that part. Just easier to scream 'America First' and call it a day, huh?

Not sure I've ever seen more desperate grasping at straws to morally equivocate an indefensible position. No surprise that a wannabe slavemaster would denigrate factory work.

It's also pretty funny though how you rail at Trump's actions on tariffs because tariffs are bad, but if Congress ok's them tariffs are good. Which is it?

One thing's for sure, you've now got zero integrity or credibility to criticize this admin's policies there frat boy.

Seems like the whipping boy would be eager to emigrate to China where all the things he values are sold cheap.

He will have a very fun time until the economy crashes like a brick as no one is buying their drivel.
