Could Biden begin rolling out preemptive pardons?
President Biden is commuting the sentences of nearly all the inmates on federal death row, a move that comes not even two weeks after he went through with the "largest single-day grant of clemency" in American history, the White House announced Monday.

Of the 40 inmates on federal death row, according to DeathPenaltyInfo.org, Biden is commuting 37 men sentenced to death, reclassifying their sentences to life without the possibility of parole.
 
The three inmates not included are: Robert Bowers, who is responsible for the mass shooting at the Tree of Life Synagogue in 2018, which left 11 people dead; Dylann Roof, a White supremacist who killed nine Black parishioners at Emanuel AME Church in Charleston, South Carolina, in 2015; and Dzhokhar Tsarnaev, who worked with his now-dead brother to perpetuate the 2013 Boston Marathon bombing that killed three people and injured hundreds.

Biden Spares Murderers Who Killed Entire Families, Including Children, Infants

President Joe Biden commuted the death sentences of 37 of 40 federal inmates on death row on Monday — including cold-blooded murderers who had killed entire families, and predators who had slaughtered innocent children.

For example, Ricardo Sanchez, Jr., and Daniel Troya had been convicted for the brutal murder of an entire family. As Palm Beach, Florida, CBS affiliate 12 News recalled, the two “shot and killed a mother, father, and their two young children”:

    The murders occurred early in the morning of October 13, 2006, when the pair stopped the family’s Jeep Cherokee along the Turnpike, outside of Fort Pierce.

    Each family member – Jose Luis Escobedo, Luis Damian Escobedo, Luis Julian Escobedo, and Yessica Guerro Escobedo – was shot and left their bodies there. Sanchez and Troya drove off in both their Dodge Ram van and the Escobedo’s black Jeep Cherokee.

President Joe Biden has acted 28 days before he leaves office to commute the sentences of 37 of 40 individuals on federal death row, converting their punishments to life imprisonment.

AP reports a long list of convicted offenders will be spared after they were sentenced for a range of criminal acts including the slayings of police and military officers, people on federal land and those involved in deadly bank robberies or drug deals, as well as the killings of guards or prisoners in federal facilities.

“I’ve dedicated my career to reducing violent crime and ensuring a fair and effective justice system,” Biden said in a statement confirming the commutations.

“Today, I am commuting the sentences of 37 of the 40 individuals on federal death row to life sentences without the possibility of parole. These commutations are consistent with the moratorium my administration has imposed on federal executions, in cases other than terrorism and hate-motivated mass murder.”

Today, President Biden announced that he is commuting the sentences of 37 individuals on federal death row. Those individuals will have their sentences reclassified from execution to life without the possibility of parole.

President Biden has dedicated his career to reducing violent crime and ensuring a fair and effective justice system. He believes that America must stop the use of the death penalty at the federal level, except in cases of terrorism and hate-motivated mass murder – which is why today’s actions apply to all but those cases. When President Biden came into office, his Administration imposed a moratorium on federal executions, and his actions today will prevent the next Administration from carrying out the execution sentences that would not be handed down under current policy and practice.

This historic clemency action builds on the President’s record of criminal justice reform. The President has issued more commutations at this point in his presidency than any of his recent predecessors at the same point in their first terms. Earlier this month, the President announced clemency for approximately 1,500 Americans – the most ever in a single day – who have shown successful rehabilitation and a commitment to making communities safer. This included sentence commutations for nearly 1,500 individuals who were placed on home confinement during the COVID-19 pandemic and who have successfully reintegrated into their families and communities, as well as 39 pardons for individuals who were convicted of non-violent crimes. President Biden is also the first President ever to issue categorical pardons to individuals convicted of simple use and possession of marijuana, and to former LGBTQI+ service members convicted of private conduct because of their sexual orientation.

The President’s criminal justice record has transformed individual lives and positively impacted communities, especially historically marginalized communities. In the coming weeks, the President will take additional steps to provide meaningful second chances and continue to review additional pardons and commutations.

President Joe Biden is commuting the sentences of 37 inmates on federal death row, the White House said Monday.

The move reduces the sentence for all but three of the 40 inmates on federal death row. Biden said that the commutations are "consistent with the moratorium my Administration has imposed on federal executions," with the exception of terrorism and hate-motivated mass killings.

The three people on the federal execution list who were not on Biden's commutation list are Dzhokhar Tsarnaev, one of the perpetrators of the Boston Marathon bombing; Robert Bowers, who was convicted of the mass shooting at the Tree of Life Synagogue antisemitic attack; and Dylann Roof, who killed nine Black churchgoers in a racially motivated shooting in South Carolina.

According to the White House fact sheet about the move, the recipients of the commutations will have their sentences "reclassified from execution to life without the possibility of parole."

I sometimes get the strong feeling that democrats want criminals to know they take their side over the law abiding citizens... and the day is nearing where criminals outnumber the law abiding.

It took probable a near decade to find these thugs guilty and millions of dollars to prosecute... All throw down the drain.

To Biden, terrorism is what justifies Tsarnaev’s continued death sentence, while hate is what justifies the planned state killing of two more: Dylann Roof, the murderer of nine innocents praying in a Black church, and Robert Bowers, who targeted a synagogue in his antisemitic murder spree that left 11 Jewish people dead.

The death penalty in Biden’s view should not be about body count or the vileness of your actions, but rather what we think of your motives.  ...

If Biden had commuted the sentences of all the scum who sit on death row and left them to rot in prison for life, I could have respected his decision. I have my own doubts about the justice of our death penalty system.

But that is not what he did. He kept the death penalty for the worst of the worst as he defined it but used completely irrational standards to show mercy to despicable hateful killers. Women and immigrants deserve the same protection from predatory hate that Black and Jewish people do. Biden should be ashamed of his double standard.

On Monday’s “CNN NewsNight,” CNN Legal Analyst Elliot Williams, who served as Deputy Assistant Attorney General during the Obama administration, said that while he thinks the death penalty should be abolished, President Joe Biden only commuted death sentences where the cases weren’t  known.

This will be Biden's legacy if left as is.

Question is, does Trump have the ability to undo this decision on the basis Biden is not functional or of sound mind, and his judgment is not such that these decisions can be upheld in any court of law.

Fact is, Biden should have been removed from office long ago, but our Congress is not worth a good BM, neither side of the aisle.

When I was young and innocent, I opposed capital punishment.  But I did a paper on capital punishment when I was in my first year at the university, read everything in print in the law library on whether capital punishment is a deterrent.  I discovered that the way we practice capital punishment is NOT a deterrent.  And why should it be when the average sentence capital punishment criminal spends almost 25 years on death row.  Back when I did my paper in 1971, it was 14.5 years.

We are a weak and mindless society.  We no longer have a moral compass as a society.  We elect people to office that make promises and then announce they believe just the opposite of what their rhetoric expressed while they were running.  We worship the criminal, the evil folks of our society, like George Floyd, who actually has statues erected in his honor across this degenerate society.

Just look at the number of fools that applauded the murder of the insurance executive in New York, with him being shot in the back.  Every person believing he deserved to be killed is a complete zero as a human being.  Biden is also a complete zero that has been permitted to exist at the highest office of the land, with no one doing a thing to correct the horrible wrong perpetrated upon the American people.  Biden has attempted to destroy everything about America, not making a single decision in the best interests of the people of the USA, or this country.

I support the death penalty.  In fact, I have come to believe it should be brutal, and it should be very public, so that every person in society can witness said execution.  And it should be swift.  Rather then let these folks sit on death row for 25 years, I say give them one year to win an appeal.  If no appeal is won after 365 days, on day 366, the perp is publicly executed.  You want deterrence, make it so that every person in our society sees what happens to an individual that has received the death penalty.

Capital punishment serves an important function.  And while it may sound harsh, it serves as a form of revenge.  Every person that loses someone to such crimes wants revenge.  There are exceptions, but most people want their pound of flesh.  And I support that human need to achieve it.  I saw a clip today of one family that is irate over the fact that Biden has denied them that justice and revenge by reducing the sentence of the man that killed their family member and another in a bank for no reason.

I SAY BIDEN IS INSANE, AND EVERY DECISION HE HAS MADE SINCE IT WAS PRONOUNCED HE WAS NOT FUNCTIONAL TO STAND TRIAL SHOULD BE RENDERED NULL AND VOID.

Trump is excellent with his promises[sarcasm], how about promising to execute everyone of these heinous murderers Biden commuted, along with the three others during your four years as the 47th POTUS. 

Mr. Council brutally murdered and was convicted of killing two people in cold blood.  He is the kind of criminal that should be executed the day after he is sentenced.  There is no mystery here what he did.

Anyone here want DETERRENT, then see that evil folks like Mr. Council receive justice swiftly!!!  And PUBLICLY for all to see and witness, even children.

I'm going to GUESS that a conservative Court will opine that the power of the pardon is absolute, and that the president's judgement (or diminishment of same) has no impact on such power.

I'm going to GUESS that a conservative Court will opine that the power of the pardon is absolute, and that the president's judgement (or diminishment of same) has no impact on such power.

The President's pardon power is pretty strong. I'm sure the left would love the ability to undo Trump's pardon, furthermore, if we could undo pardons, it would basically turn the power into a joke. Fact is that blind justice gets it wrong sometimes which is why the pardon power is an important part of our justice system.
