But don't celebrate yet: This is actually a desperate bid to get him convicted on the second charge, and his defense team opposed it for that reason. The whole move may well be illegal.

The max for the second, milder charge, is 4 years in prison. The first one would have been the 15 years. Neely's family is probably furious (get ready for protests regardless), and DA Bragg is livid.

There IS much to comment on the particulars of this case, as video shows that Penny could have released Neely without danger to himself and others as there were two grown men over Penny ready to help, and the subway car had emptied. (Even the prosecution commended Penny for his intentions.)  He may have simply held the strangle hold too long.  But hindsight IS 50/50. Penny may have been in "soldier mode" and not able to stand down easily.  It can be such a reflex reaction, I'd think.....

A Republican congressman is seeking to honor Daniel Penny, the Marine veteran currently facing trial over the death of Jordan Neely, with the Congressional Gold Medal. Rep. Eli Crane (R-AZ) announced his intention to introduce a resolution on Friday to award Penny the prestigious civilian honor.

Crane’s bill argues that Penny acted to “protect women and children” on a New York City subway on May 1, 2023, when he restrained Neely, a homeless man with a history of mental illness and prior arrests. Neely later died, and Penny was charged with manslaughter.

“Daniel Penny, with others, acted to save New York City subway riders from threatening be10 havior by restraining a criminal – who had 42 prior arrests and an active warrant – until the police came,” the draft resolution reads. “The courageous actions taken in response to the threat to his community by Daniel Penny, a decorated U.S. Marine Corps veteran, went beyond the civilian call of duty.”

“It is the sense of the Congress that Daniel Penny, with integrity and honor that is characteristic of who he is and of his honorable service in the United States Marin Corps, stepped in to protect women and children from an individual who was threatening to kill innocent bystanders, and he is a hero.”

Frankly, I am sick and tired of blacks in the USA crying racism.  I have in my entire life never once witnessed an act of racism. 

The family of the dirt bag that died has already sued for millions in a civil suit.  Our legal system is not worth a good BM.  and the stinking lawyers and judges that have ruined the legal system need to answer for the mess they created.

And bottom line, since when did a coroner's finding impact anything in recent years?  Ever since the coroner indicated George Floyd died of a drug overdose, the morons of Minnesota completely disregarded truth and justice.  No way any of those officers should have been indicted.  Same with Penny.  He is a hero, and the dirt bag's family should be forced to pay for the trouble their worthless son caused to society.

If he is not exonerated on all charges, good luck if you are in trouble, because NO ONE will come to your rescue.  New York is such a f***ed up state and its people could not be dumber.  They hold themselves to be something better, and they are all idiots.

I went in 2011 when my son's high school band was marching in the Macy's Thanksgiving Day Parade, and I'm right there with you.  It was a fun place to visit once.  I don't have any interest at all in going back.  There is just too much small-town girl left in me, I expect.
