Unarmed Capitol protester shot by officer who admitted he didn't bother to assess her intentions

A federal judge has ordered the U.S. Department of Justice to answer a $30 million wrongful death lawsuit filed on behalf of the estate of Ashli Babbitt.

The unarmed protester was at the U.S. Capitol on Jan. 6, 2021, like many others, opposing the certification of Joe Biden as president.

In a crowd in the building, in which two individuals already had dislodged the glass panels in the lobby doors, she was raising herself into the opening when Capitol police officer Michael Byrd shot and killed her.

According to Judicial Watch, which is pursuing the case on behalf of the estate of the Air Force veteran, the government agents are accused of wrongful death, assault and battery, negligence.

Judicial Watch explained, "The shooting occurred at the east entrance to the speaker's lobby. After demonstrators filled the hallway outside the lobby, two individuals in the crowded, tightly packed hallway struck and dislodged the glass panels in the lobby doors and the right door sidelight. Lt. Byrd, who is a United States Capitol Police commander and was the incident commander for the House on January 6, 2021, shot Ashli on sight as she raised herself up into the opening of the right door sidelight. Lt. Byrd later confessed that he shot Ashli before seeing her hands or assessing her intentions or even identifying her as female. Ashli was unarmed. Her hands were up in the air, empty, and in plain view of Lt. Byrd and other officers in the lobby."

No they weren't...she was busy trying to climb through a broken window into a secure area with police guns drawn on her.  Sorry, but she was stupid and I don't have that much sympathy for her.  And those people trying to smash the door in were certainly not peaceful either.

No they weren't...she was busy trying to climb through a broken window into a secure area with police guns drawn on her.  Sorry, but she was stupid and I don't have that much sympathy for her.  And those people trying to smash the door in were certainly not peaceful either.

When the gun fired, I couldn't see Ashli in the video. From what I saw in that video, Lt. Byrd had no reason to fire his handgun.

Byrd was off to the side, hidden, waiting to ambush anyone who thought to go through the window broken out by Antifa.  (Yeah, there's video of that, too.)  Byrd went for the head shot.  No body shot.  No leg shot.  But a head shot.  And he did so with other Capitol Police on the other side of the barricade.

Byrd wanted to shoot someone that day.  No question about it.

If he had stood out in the middle of the hall with his gun drawn, no one would have even tried to crawl through.  Especially a military veteran.  But no.  He hid in the shadows, waiting for his opportunity to shoot someone.  And the fact that Capitol police were on the other side of the barricade makes it even more heinous.

In most States, you are allowed to shoot an intruder who enters your house, but not one who is still outside.  Ashli Babbit (Say her name!) was still technically outside.  If this had been a homeowner, he would be charged with a crime.

I feel ya, bruh.  But it still illegal in most States.  Not sure about Alabama law yet.  But in Georgia, you shoot someone outside your house, you better drag their body inside the door before calling police.

I didn't say she was shot in the head.  I said the shooter was aiming for her head.

Frankly, I do believe there were infiltrators in the crowd. But looking at the video, I'm not sure how I would react to that situation.  I don't know that anyone knew, at the time, what was going on.

I don't think so...he was close enough that he could have easily shot her right between the eyes, but he didn't.  I think he was trying to wing her...and if he really wanted to kill her then he would have fired a whole lot more shots instead of just one.

Yeah, she shouldn't have been trying to break that door down with the others and then climb through that window into a secure area with a Capitol police officer guarding it with service weapon drawn.
