Energy, Business Groups Ask Supreme Court To Stop California From Forcing EVs On the Rest of America

Numerous trade associations are asking the Supreme Court to review a lower court’s decision that effectively allowed California to push electric vehicles (EVs) on the rest of the U.S.

The coalition of plaintiffs are asking the highest court in the land to take up a review of the D.C. Circuit’s dismissal of a previous challenge against the Environmental Protection Agency’s (EPA) approval of a California Air Resource Board (CARB) request to pursue tailpipe emissions standards that are more stringent than federal requirements. If the Supreme Court were to take the case and decide favorably for the plaintiffs, the ruling could potentially deal a serious blow to California’s de facto ability to dictate emissions standards and force EVs on the rest of the country, a spokesperson for one of the involved trade associations suggested.

“We are asking the Supreme Court to reverse the D.C. Circuit’s erroneous holding that fuel providers lack ‘standing’ to challenge EPA’s unlawful California waiver, and also to provide long overdue clarity on the authority of EPA and California to mandate electric vehicles,” said Chet Thompson, AFPM’s president and CEO. “California is not a ‘super state,’ its Clean Air Act carveout does not give it special privileges to regulate greenhouse gas emissions standards or dictate what types of car and truck powertrains can be sold in this country. Well I would much rather that than the socialist democrat mofos here in California being able to force their insanity on the rest of the  nation, iit's bad enough us normals in the state  have to deal with it.

Companies can just stop doing business in California.

Traditionally, that would be too many customers or too much market share to forfeit to competitors. 

But, competitors having to comply with Cali rules and regualtions, may actually put them at a competitive price disadvantage elsewhere.

Yup. I ain't ever been through emissions testing (for my rigs, I mean)...Not one time in my whole life... Why the hell would I start letting em do this now?

Knew a guy in Colo who had replaced the engine in his ride, had done some things with the ignition system (MSD, for one) and the fuel system...
His tailpipe emissions were cleaner than the vehicle got when brand new and stock.

Unfortunately, the law required the same dirtier burning equipment under the hood and elsewhere that the factory had installed.

His vehicle failed the inspection because it wasn't stock, even though it ran cleaner than stock vehicles did brand new. :shrug:

`I've done similar... MSD or an Accel Super Coil, a little jiggering with the timing, and all the smog crap ripped off... 350 Chevy...Flattop pistons and 202 heads, 300 hp blueprint cam with an Edelbrock 625cfm passed inspection in Washington state...

Same thing though - Couldn't keep it because it wasn't stock. He brought it back to me, and I resold it here.

But I know there's hot-rodders there. I dunno how they do it  :shrug:

It depends on the type of registration. Hard to be street legal in some places if your horsepower is too high, etc., but mostly in states that care, they want OEM all the way, clean or not.

We have an average of 9.7 people per square mile, but nearly half of the people in the state live in Fargo, Grand Forks, and Bismarck/Mandan, so the actual rural population density is about half of that.

I get that... We're around 7/mi, until you take away G.Falls/Butte/Bozeman/Belgrade and Helena/Missoula. Get rid of them there's hardly anybody left. And I like it like that.  happy77

The fat lady has sung for EVs.  They are not a long term solution.  As quickly as they came about, they will disappear.  Musk better find another type of vehicle to build, because the USA will not subsidize EVs forever.  Other technology is already being developed and will supplant EVs.
