Quote
Amy Coney Barrett makes her mark

    Sam Baker

Justice Amy Coney Barrett is establishing herself as a new intellectual center of gravity on the Supreme Court.

The big picture: This is what Barrett's biggest fans predicted when she was first nominated — that she would not only be a solid right-leaning vote, but an influential justice with the potential to shape the broader contours conservative legal doctrine.

And Barrett is just as conservative as everyone knew she would be. She joined the court's rulings overturning Roe v. Wade, expanding gun rights and curtailing the powers of the federal government.
But she is beginning to separate herself from the pack in important ways.

She seems less willing than some of her colleagues to fast-forward through parts of the legal process just to reach a particular outcome.

She has explicitly criticized some of the ways other conservatives use historical analysis to solve modern questions.
And in the term that just ended, her positions were significantly less favorable to former President Trump than those of any other Republican appointee.

Advice to Mr. Trump:

If you're re-elected, and have the opportunity to nominate more justices to the Supreme Court, you should choose ONLY nominees who are:
- male
and
- white.

I am unimpressed by Tumpy's appointments, other than Gorsuch, who has surprised me greatly.

But for the topic at hand... It must be understood that ACB is the junior-most justice, and as such may be acting in the Court's favor, where the Court wishes to convey a decision that suggests unity instead of voting down party lines. Enough votes for the decision, and the wildcard may be used to fend off the idea that it was a partisan vote.

And that's a fair thing to do. And the only way we'll know that was the case is if ACB moves rightward in decisions after a new junior right-leaning judge is installed.

Not sayin. Jussayin.

@Fishrrman

Well....

David Souter was a white male.

Clarence Thomas is a black male.

Both were appointed by Republican presidents. Which one worked out for the better?

Just sayin'.  Race and gender don't matter if ideas and adherence to Constitutional principles are of primary importance.

  • Dems-greatest existential threat to USA republic!
ACB is not the most junior member of the court.  The idiot that could not provide the definition of WHAT IS A WOMAN is the most junior member.

And if you watch the three appointees by Trump, it appears to me that they take turns being on the liberal side of the fence on almost every vote.  Why or how any of them can ever vote on the liberal side of things makes no sense to me.

From the Right, I mean... And I agree otherwise, except Gorsuch. I expected him to be moderate and he has largely voted Conservative. Kavanaugh has been exactly as expected - Moderate, leaning liberal, And Amy-Coney-Barrett Has been surprisingly left of as-advertised.

Today, you have to take into account the very real possibility of blackmail/extortion.

For example, Amy Coney Barrett may have had her family threatened.

Unfortunately, they don't raise future SCOTUS judges sealed in mayonnaise jars on the front porch ala Johnny Carson's 'Karnack' with Ed McMahon.

Clarence Thomas is the most consistently conservative justice on the court... by far. Don't give that nonsense about whiteness mattering.
