The Biden Administration on Tuesday afternoon released the details of President Biden's executive action that offers permanent residence to some non-citizens without congressional approval – a measure House Speaker Mike Johnson argues will encourage more illegal immigration into the U.S.

“Just two weeks ago, the president pretended to crack down on the open-border catastrophe by engaging an election-year border charade. Now he’s trying to play both sides and is granting amnesty to hundreds of thousands of illegal aliens," the Louisiana Republican said.

"The president may think our homeland security is some kind of game that he can try to use for political points, but Americans know this amnesty plan will only incentivize more illegal immigration and endanger Americans," Johnson said in a statement. 

Johnson also said the executive action is "proof-positive of the Democrats’ plan to turn illegal aliens into voters.

He argued that Biden's executive action violates the Immigration and Naturalization Act and predicted that it will be "challenged and struck down in the courts."

Biden's executive action, posted Tuesday afternoon on the White House website, establishes a new process to "help certain noncitizen spouses and children apply for lawful permanent residence" without leaving the country.

"This action will protect about half-a-million spouses of U.S. citizens, and roughly 50,000 noncitizen children under the age of 21 whose parent is married to a U.S. citizen," read a White House fact sheet on the executive order.

The Immigration Reform Act of 1986/1987 gave amnesty to 11 million illegal immigrants, at that time, in exchange for more rigorous enforcement.

Sen. Ron Johnson, R-Wis., said Tuesday that President Joe Biden's recent border order is telling illegal immigrants to come quickly to the U.S. before there is a potential new president.

"Come as quickly as you can before the presidency changes," Johnson said on the "Just the News, No Noise" TV show, describing what Biden's border order tells the world. "Democrats want an open border. 'We're going to welcome you, but we are going to expect you to vote for Joe Biden.'"

President Joe Biden announced an executive order Tuesday that could effectively provide amnesty to well over 500,000 illegal immigrants in the United States — but the move may not pass legal muster.

Speaking Tuesday at a White House event commemorating the 12-year anniversary of the Deferred Action for Childhood Arrivals (DACA) policy, Biden unveiled his own executive order laying out a plan to give deportation protection, work permits and a pathway to legal status to hundreds of thousands of illegal immigrant spouses. Those eligible must have lived in the U.S. for at least 10 years, be legally married to a U.S. citizen and be ultimately approved by the Department of Homeland Security (DHS). The illegal immigrants approved under the order will have three years to apply for permanent residency, allowing them to remain in the U.S. and gain work authorization.

A Republican strategist said Wednesday that President Joe Biden was throwing a “Hail Mary” with a proposal allowing illegal immigrants married to American citizens to remain in the country.

Biden announced an executive order on Tuesday that would allow certain illegal immigrants who are married to American citizens to receive work permits, remain in the United States and receive a pathway to legal status. Bryan Lanza, a former campaign aide to former President Donald Trump, expressed doubt that Biden’s effort would help him stem losses of Hispanic voters. “He’s underwater with immigration, and he’s losing a lot of ground with Latinos, so it’s a Hail Mary to try to bring them back,” Lanza told “CNN This Morning” guest host Mau Raju. “Because the last three years his economic activities, his economic messages, economic deliveries have been a failure to Latino communities, specifically working-class Latinos and middle-class Latinos, so he needs something, he needs — he needs a Hail Mary, and this is it.”
