Surveillance footage of Hallie Biden throwing Hunter's gun away and searching for it later released


The surveillance footage of Hallie Biden throwing Hunter Biden's gun away and later going back to look for it on October 23, 2018, has been released by the court.

One clip from Janssen's Market showed Hallie pull up to the store in a BMW and retrieve the gun, which had been placed in a small "gift bag," from the back seat. She then walks to the front of the exterior of the store and placed the bag in an outdoor trashcan.

A separate clip showed Hallie return to the store to frantically search for the gun, which was nowhere to be found at the time. She testified that she asked store employees whether the trash had been taken out.

Hallie testified Thursday that she was cleaning Hunter's car and found the gun, bullets, and remnants of what she believed to be drugs. Hallie described feeling "panicked" and "wanted to get rid" of the gun because she "didn't want him to hurt himself."

"I realize it was a stupid idea now, but I was panicking," Hallie said Thursday.

After finding out what happened, Hallie said Hunter told her to go to the store, look for the gun, and if it wasn't there to file a police report since it was registered in his name. She later filed a police report at Janssen's Market.

Former state trooper testifies about tracking down gun

Former Delaware State Trooper Millard Greet, who now works an investigator for the Justice Department, testified Thursday about the alleged incident in which Hunter Biden's gun was thrown in the trash.

Greer testified that he reviewed the security footage on site and for several days after receiving a USB with the footage.

That footage, which was played in the courtroom, showed an elderly man driving up to the Janssens Market trash cans and looking through the trash before eventually finding a gun.

Greet testified that he interviewed people at the market and was told that the man would often rummage through the trash for recyclables.

Greer said he was then able to locate the man, who locals called "Ed, himself and interviewed him, with the man telling Greer that someone left behind something they shouldn't have in the trash can.

Greer testified that he then went to the man's house to retrieve the gun, and Ed told the trooper that the pouch with the gun contained chapstick, a speed loader, and a box of bullets. Greer said all of the items were taken into evidence.

Greet then testified that he called Hunter Biden to ask if he would like to seek prosecution, to which Biden answered no.

Hunter was considered victim of crime when police searched for his missing gun

Delaware State Police Senior Cpl. Joshua Marley testified Thursday in court about his response to the incident at Janssen's Market and his interactions with Hunter Biden, who he considered to be a victim of a gun crime at the time.

Marley's testimony lasted for less than 30 minutes as he answered questions from both the prosecution and defense.

Marley gave his account of What happened on the day he received a call and reported to Janssen's on October 23, 2018 – the day Hallie Biden disposed of Hunter's recently purchased firearm in a trashcan there.

When Marley was told what happened about the missing gun, he searched the trash cans and found nothing related to the gun or the gun itself. Hunter then showed up and they interviewed him.

After continuing to search, they had no luck locating the firearm. At this point, Hunter was considered the victim of a crime, and Hunter did not know the serial number of the gun in question when he was asked for it.

Under cross-examination, defense attorney Abbe Lowell attempted to double check the sequence of events.

Marley said he did not remember seeing Hallie at all after completing what he had to do at the grocery store. Marley said he then went to Starquest Shooters and Survival Supply to get the serial number to put into the NITC system in case the gun was used in a crime.

Lowell asked Marley if he ever saw the ATF Form 4473 that Hunter had filled out when he purchased the firearm, but the officer did not ask the store owners for it.

The fourth day of Hunter Biden's trial for federal gun charges has concluded.

Court adjourned for the day around 4:45 p.m. ET. Hunter departed the courthouse at 4:53 p.m. ET.

The prosecution called several more witnesses to the stand Thursday, including Hallie Biden, the widow of Beau Biden and Hunter's ex.

During her testimony, Hallie recounted a June 2018 trip to Los Angeles to meet Hunter at the Roosevelt Hotel, where she used drugs, specifically crack cocaine. She testified that Hunter introduced her to and gave her the drugs. She said she continued using drugs until August 2018, the same month she revisited Hunter at a treatment facility.

Asked about her and Hunter's relationship, Hallie testified that they were romantically involved from late 2015 through 2016 and it was at that time that she learned about Hunter Biden's drug use. Hallie testified that she watched Hunter Biden obtain crack and that his behavior was agitated and high strung.

According to her testimony, Hunter visited Hallie on October 22-23 of 2018. She testified that Hunter came to the house, and that he seemed exhausted. She said that he could’ve been on drugs at the moment. When Hunter went to bed, Hallie decided to clean out his car. She said she had done this before to see if there were any remnants of potential drug use, or alcohol.

When prosecutors asked what she had found, she testified that she found remnants of crack, cocaine, dirty clothes, trash, and the gun.

Prosecutors then pulled out the actual gun that Hunter purchased and brought it to the witness stand. They asked Hallie to identify the firearm, and she said it looked very similar to the gun that she had seen in the car.

Others who took the witness stand Thursday include: Delaware State Police Senior Cpl. Joshua Marley, who responded to the incident at Janssen's Market, the location where Hallie disposed of Hunter's gun; retired Lt. Millard Greer, who offered testimony on how police discovered the gun at the center of the case; and Edward Thomas Banner, the man who recovered Hunter Biden's gun from a dumpster.

Prosecutors and defense question man who fished Hunter Biden's gun out of dumpster

Edward Thomas Banner, the man who recovered Hunter Biden's gun from a dumpster, took the stand Thursday in court.

Banner, 80, wore a blue suit jacket with a light blue undershirt and glasses to court and had trouble sitting in the witness chair, so Judge Maryellen Noreika helped him. Banner said he served in the Navy for four years, and has been married to his current wife for about 11 years.

Banner had trouble hearing, so prosecutor Derek Hines delivered his questioning next to the witness stand.

Hines asked Banner about his recycling hobby. Banner said he did it to make money, adding "especially now with gas prices."

Banner said he remembered the day when he found the gun, though he didn't remember the exact day.

Surveillance footage played in court showed Banner retrieving the gun from the trash can outside of Janssen's Market.

Hines asked Banner if anyone in his house used cocaine, to which Banner said no.

During cross-examination, Banner was asked by Lowell about specifics from the day when he found the gun. Lowell then asked if the gun was kept in a sock after officer Millard Greer testified in court that the gun was in a sock when Banner gave it to him.

Banner couldn't recall the gun being in a sock, saying, "I don't know nothing about no sock."

I thought so too...NYPost isn't doing very much with a live thread so I switched to Fox...

I noticed Fox News has a lot more details in this trial, compared to the Trump Trial fiasco.  Different Reporters?

The difference is that this case involves an actual crime.  It's hard to come up with details when there is nothing to detail.

First lady Jill Biden returned to Wilmington, Delaware on Friday to support her son Hunter Biden at his criminal trial.

The first lady was in France with President Biden the day before to attend a ceremony commemorating the 80th anniversary of D-Day.

In part of President Biden's speech to D-Day veterans, he appeared to misspeak while urging allies to support Ukraine in its war against Russia, saying that hundreds of thousands of Russian military personnel were killed in Ukraine.

"They've suffered tremendous losses with Russia – the numbers are staggering, 350,000 Russian troops dead or wounded," he said.

Later, Biden claimed in an ABC interview with David Muir that he's known Vladimir Putin "for over 40 years," notwithstanding the fact that Putin served as an undercover KGB intelligence officer for the Soviet Union throughout the entire 1980s.

"I’ve known him for over 40 years. He’s concerned me for 40 years. He’s not a decent man," Biden told Muir.

Forensic specialist testifies in Hunter Biden's gun crime trial

The jury was seated for the fifth day of Hunter Biden's gun crime trial on Friday.

Shortly after, Dr. Jason Brewer, a forensic chemist, was called by the prosecution to the witness stand.

Brewer is expected to be asked about his analysis of the brown leather pouch that allegedly belonged to Biden and his opinion that the residue is cocaine based on his testing and evidence, prosecutors said ahead of his testimony.

House Republicans refer Hunter Biden, James Biden for criminal prosecution amid impeachment inquiry

House Republicans are sending criminal referrals to the Justice Department recommending Hunter Biden and James Biden be charged with making false statements to Congress about "key aspects" of the impeachment inquiry of President Biden, Fox News Digital has learned.

House Oversight Committee Chairman James Comer, R-Ky., House Judiciary Committee Chairman Jim Jordan, R-Ohio, and House Ways and Means Committee Chairman Jason Smith, R-Mo., who have been leading the inquiry, sent the criminal referrals to Attorney General Merrick Garland and Special Counsel David Weiss on Wednesday, saying the alleged false statements "implicate Joe Biden’s knowledge and role in his family’s influence peddling schemes and appear to be a calculated effort to shield Joe Biden from the impeachment inquiry."

House Republicans allege Hunter Biden "falsely distanced himself from a corporate entity — Rosemont Seneca Bohai, LLC — and its bank account (Rosemont Seneca Bohai Bank Account) that was the recipient of millions of dollars from foreign individuals and foreign entities who met with then-Vice President Biden before and after transmitting money to the Rosemont Seneca Bohai Bank Account that then transferred funds to Hunter Biden."

"Hunter Biden made additional false statements as to whether he held positions at Rosemont Seneca Bohai, LLC. After deposing Hunter Biden, the Committees obtained documents showing Hunter Biden represented that he was the corporate secretary," they wrote. "Additionally, Hunter Biden during his testimony relayed an entirely fictitious account about threatening text messages he sent to his Chinese business partner while invoking his father’s presence with him as he wrote the messages. Hunter Biden told the Oversight Committee and the Judiciary Committee he had transmitted this threat to an unrelated individual with the same surname. However, documents released by the Committee on Ways and Means demonstrate conclusively that Hunter Biden made this threat to the intended individual, and bank records prove Hunter Biden’s Chinese business partners wired millions of dollars to him after his threat."

They added: "A portion of the proceeds has been traced to Joe Biden’s bank account."

Biden family members including First Lady Jill Biden have attended the trial to show support for Hunter Biden as he faces criminal charges for allegedly making false statements on a federal form when he purchased a gun in 2018.

Cocaine residue found in pouch Hunter Biden used to store gun: forensic chemist

Dr. Jason Brewer, who is considered an expert witness in the field of forensic chemistry, testified Friday that the testing he conducted on the brown leather patch used by Hunter Biden to store the gun contained cocaine residue.

The prosecution presented government exhibit 4 to Brewer on the stand, and showed pictures of that exhibit, which is the brown pouch where the gun was stored.

Inside the flaps, and on the bag, a small amount of white powder was seen. Samples of it were taken by Brewer.

Based on the testing conducted by Brewer, his conclusion was that residuals of cocaine were identified in the sample. He could not specify whether it was crack specifically because there was such a small sample.

Brewer could only tell if there were drugs present. He cannot speak to anything about who put them there and when the cocaine was put there.

Dementia Joe isn't capable of traveling anywhere without Jill.  She couldn't be there for her son yesterday because she had to accompany her husband to Normandy and direct his every move, which apparently included those of his bowels as well.

I stand corrected.  Joe remains in France for another day while Jill travels back to Delaware intimidate the jury.

DEA expert sees coded drug language in Hunter Biden's messages

Prosecutions questioned DEA Supervisory Special Agent Joshua Romig -- considered an expert witness on drug trafficking-- on various terms, explanations and context for drug related terms, and how drugs like crack cocaine get into the United States.

They explained what a dime bag. Then prosecution brought up text messages between Hunter Biden and various dealers, and family members throughout 2018-19, including messages with Hallie Biden.

They asked him to identify and  efer to certain instances of when they were discussing drug deals or purchasing of drugs.

For example, when Hunter Biden asks for "baby powder" or "soft powder," Agent Romig refers to that as code for powder cocaine.

Notably, Agent Romig describes what a "choreboy" is to the jury -- a scouring pad and filter for a crack pipe that is very common.

He also identifies various pictures of Hunter using a crack pipe, or something similar, and videos of scales and drugs he texted.

Prosecution rests in Hunter Biden gun trial

The prosecution rested its case against Hunter Biden in court on Friday, prior to a brief break.

The government presented ten witnesses over about three and a half days.

The defense is now expected to call its witnesses to the stand.

Following the court's 20-30 minute break, defense attorney Abbe Lowell is expected to make a motion for Rule 29, which is a motion for acquittal that typically happens after the government presents its case. Judge Maryellen Noreika is likely to issue a ruling on that before Lowell begins his case. There's still no word on who he will call to the stand first.

Defense asks if gun store owner was trying to rush sale to Hunter Biden

Ronald Palimere, the owner of StarQuest Shooters & Survival Supply, took the stand briefly in court on Friday and was questioned by the defense on whether he rushed the sale of the firearm to Hunter Biden.

Palimere said he never talked or met with Biden in the show room. He also didn't remember anything about the background check.

Defense attorney Abbe Lowell asked him if he was trying to rush the sale in anyway.

“I was trying not to hold him up,” Palimere responded.

The witness only took questions from the defense. The prosecution decided not to follow-up with questions.

Defense calls Naomi Biden to the stand


The defense has called Naomi Biden, the eldest daughter of Hunter Biden and Kathleen Buhle, to the stand.

Naomi's mother testified earlier this week in the trial.

Buhle said during Wednesday's testimony she discovered Hunter was using drugs when they were married and that she found a crack pipe on an ashtray on the side porch of their D.C. home on July 3, 2015.

Buhle also said when Hunter was using drugs he was “not himself” and “angry, short tempered, and acting in ways he didn’t when he was sober.” She said he was “smoking crack the day after our anniversary.”

Naomi Biden, Hunter Biden's daughter, concluded her emotional testimony in her father's ongoing gun trial shortly before the court broke for lunch on Friday.

When Naomi took the stand, Hunter dabbed his eyes with a tissue. He paid close attention to Naomi. She seemed uncomfortable on the stand.

Under cross-examination, Naomi was asked by prosecutor Leo Wise if she knew her father had been doing drugs.

"Yes, I knew that he was struggling with addiction," she said. "After my uncle died things got bad…"

Asked whether she had witnessed her father using drugs, Naomi said, "No, I never saw him use."

When Naomi left the room she was in tears and hugged her dad.

Jill Biden and the president's sister, Valerie Biden Owens, looked upset when they walked out of the courtroom with Hunter.

The court broke for lunch around 12:45 p.m.

Hunter Biden's daughter testifies she saw her dad in rehab months before gun purchase

Naomi Biden, Hunter Biden's eldest daughter, testified that her father was in rehab and seemed to be doing better in the summer of 2018.

She testified as a defense witness that she visited him in Los Angeles and that he seemed the clearest "since my uncle (Beau Biden) died."

Naomi said she told Hunter that she was "proud of him."

Defense attorneys have argued that prosecutors have not sufficiently proven that Hunter Biden was actively using drugs around the time he purchased a gun in October 2018. Biden is charged with lying on a federal form to purchase the firearm that he was not an active drug user or addicted to narcotics.

Naomi Biden also testified that in mid-October 2018 -- after the gun purchase -- she drove Hunter's truck from D.C. to New York, and didn't find any drugs in the car.

She told the court at the start of her testimony that she was "nervous."

Naomi Biden is the third witness called by defense attorney Abbe Lowell. The prosecution rested it's case Friday morning.

One of the prosecution's star witnesses was Hallie Biden, Beau Biden's widow, who testified that she believed Hunter Biden was likely on drugs in mid-October 2018.

"I think if the jury is paying attention to the presentation that the prosecutors are putting on, the presentation that's occurring in the front of the courtroom, these witnesses did a lot of damage to Hunter Biden," said Holloway.

"t's obvious that at the relevant time when he bought that gun, he was both addicted to drugs and he was also an unlawful user of drugs, particularly I think crack cocaine being the big one," he continued.

"But here's the thing, Harris. There's another presentation that's taking place in that courtroom, and it's for the benefit of the jury. The presence of the First Lady, the presence of the rest of the Biden family, all that stuff is there for the jury to see. The defense has orchestrated it for the benefit of the jury," he said.

"They're trying to evoke sympathy. This is in the Biden's backyard. There's bound to be people on that jury who have great affection for at least some of the Bidens," he added.

"So this is an effort to get jury nullification which is of course when the jury says okay, maybe he's he's guilty, the evidence is there, but we're gonna give him a pass anyway, that's they have the power to do it. The lawyers cannot directly ask for it, but they're doing it in the way that you see playing out in the courtroom," he said.

Hunter Biden considering testifying as fifth day of trial concludes

The fifth day of Hunter Biden's trial for federal gun charges has concluded.

Court adjourned for the day around 1:50 p.m. ET. Hunter Biden departed at 2:03 p.m. ET.

Defense attorney Abbe Lowell said he will decide over the weekend whether he will call Hunter to the stand. That decision will come over the weekend and Lowell, who departed from court shortlt after 2 p.m. ET, said he would notify the office of Special Counsel David Weiss to tell them the decision.

If the defense does call Hunter to the stand, the prosecution indicated they may put on a rebuttal witness.

James Biden, the president's brother, was seen departing the courthouse at 1:40 p.m. ET.

James Biden was one of a handful of individuals expected to be called to the stand by the defense to testify.

Court resumes at 8:15 a.m. ET on Monday.

Prosecutor Leo Wise asked Naomi Biden, Hunter Biden's daughter, about the condition of Hunter’s truck when she borrowed it roughly a week after Hunter purchased the gun.

Naomi said she did not see anything like “remnants” of cocaine in the truck, or any other drug paraphernalia.

This detail is key because she gives the truck back to Hunter on Oct.19. Four days later, on Oct. 23, Hallie Biden finds the gun in the truck. She also finds what she called “remnants” of crack cocaine and some paraphernalia, such as a crack pipe, along with the gun.

She called it a “dusting” of powder. This is key because at this point Hunter Biden had the truck.

The government is trying to show that he was using crack between Oct. 19 and Oct. 23., only one week after he bought the gun and filled out the form at the center of the whole case, where he checked a box that said he was not at the time a user “or addicted to” any controlled substances.

"I thought they put together an airtight case," Turley said.

"They did an excellent job anticipating the arguments of the defense. And so you have had Abbe Lowell, the defense counsel, making a series of claims in his opening statement that the government proceeded to knock down within 48 hours."

"It was a series of arguments that the prosecution did an excellent job knocking down," he said, and added that he doesn't think "there's any discernible defense strategy here other than a nullification strategy."

"Because the arguments put forward by the defense seem to be a mere pretense, almost placeholders, for a nullification vote by one or more jurors. And there's hope for that," he said.

"This is a great jury pool for Biden, this is Biden-town. This is their hometown. And they're reminded of that with the First Lady, who's who's flying in from Europe just to have another day there, and then flying back to Europe. So that message is really being reinforced," Turley said.

"I'm sure the prosecutors are not thrilled by it. But also every juror says they know someone who struggled with drugs. And the combination of that, I think the defense hopes. might get a couple of them to look beyond the evidence. And vote, sort of in an empathic way for the defendant or what he's going through," Turley said.

Hunter Biden arrives to courthouse with smirky greeting to family members

Both of President Biden's siblings are in attendance at the sixth day of Hunter Biden's criminal trial in Delaware on Monday.

Valerie and James Biden were seen speaking to one another outside the courthouse as Hunter arrived. Hunter could be seen smirking as he approached the the duo. They exchanged greetings and then entered the courthouse together.

Monday's proceedings could see Hunter take the stand to testify in his own defense. His attorney, Abbe Lowell, indicated last week that he would decide on Monday whether Hunter should testify.

If he does testify, his questioning is likely to last most of the day. If he does not testify, however, the defense could move forward quickly to jury deliberations.

Hunter faces a maximum sentence of 25 years in prison if he is convicted on all charges.

Jill Biden arrives to courthouse as defense set to decide on Hunter Biden testimony

First Lady Jill Biden arrived to the Delaware courthouse for day six of Hunter Biden's federal gun crime trial on Monday.

Jill joined President Biden's siblings, Valerie and James Biden, inside the courthouse. The defense is set to decide whether Hunter will testify on Monday. His testimony would likely take most of the day, according to his attorney, Abbe Lowell.

Prosecutors are working to prove that Biden lied on a federal firearm form, known as ATF Form 4473, in October 2018 when he ticked a box labeled "No" when asked if he is an unlawful user of a firearm or addicted to controlled substances. Hunter Biden purchased a Cobra Colt .38 from a store called StarQuest Shooters & Survival Supply in Wilmington.

Biden is facing charges of making a false statement in the purchase of a gun, making a false statement related to information required to be kept by a federally licensed gun dealer, and possession of a gun by a person who is an unlawful user of or addicted to a controlled substance.

He pleaded not guilty in the case. It is the first time in U.S. history that a sitting president's child is on trial.

The total maximum prison time for the three charges could be up to 25 years. Each count also carries a maximum fine of $250,000 and three years of supervised release.

Fox News legal analyst Gregg Jarrett discusses the impact Hunter Biden's testimony could have if he is called to the witness stand in his federal gun trial.

"His problem is there is no defending the indefensible. The evidence overwhelming. He lied, he incriminated himself on the laptop, in his own book, witnesses confirmed the lie," Jarrett said.

Jarrett also discussed Hunter Biden's defense, which Jarrett argued was thin and may depend on a friendly jury in Delaware.

"It's Delaware, it's the Biden's personal theifdom, and it's a friendly jury," Jarrett said. "His main defense is really quite desperate. That he was so addicted that he was in denial about his addiction therefor didn't knowingly lie. But under the law being addled by drugs is not a defense, which means... his real defense is a combination of sympathy for a recovering addict and jury nullification, ignore the facts, disregard the law."

Hunter Biden's alleged gun crime is "far more clear cut" compared to former President Donald Trump's trial, Fox contributor and editor at large of The Spectator, Ben Domenech, said Sunday on Media Buzz.

"It's a document that you have to sign under under penalty of perjury," Domenech said. "Everybody has to do this when they're buying a firearm, and in his case, Hunter obviously lied on that forum when he said that he was not addicted to any drugs when he said that he was able to purchase this weapon."

"The irony of this is actually the Joe Biden himself signed a law into effect that made the penalty for this type of crime higher than it was in the past historically," he added.

Domenech suggested that while Trump's private business records faced scrutiny, Hunter Biden's recent media attention has revealed "the degree to which this had gone off the rails as much as it had."

"I think there were a lot of people who were learning these things about Hunter Biden for the first time," he said. Nonetheless, Trump's charges "was a completely different standard."

What You Need To Know About Hunter Biden's Motion To Dismiss

Hunter Biden’s legal team asked the federal judge presiding over his criminal gun trial to toss out the case in three motions filed on Friday. Those motions present legal arguments for the court to consider apart from the factual questions that could be put before the jury as early as Monday should Hunter Biden opt against taking the stand to testify in his own defense.

Here’s your lawsplainer on the three motions to dismiss.

Motion to Dismiss for Insufficient Evidence

The first motion the lawyers filed on behalf of Hunter Biden was the standard motion for acquittal that argued prosecutors failed to present sufficient evidence to convict the president’s son of the crimes charge. Defense lawyers routinely — and by default — make a motion for acquittal because otherwise, the defendant cannot challenge the sufficiency of the evidence on appeal.

A motion for acquittal tests whether the government has presented sufficient evidence to convict the defendant. As the Supreme Court has explained, “Sufficiency review essentially addresses whether ‘the government’s case was so lacking that it should not have even been submitted to the jury.’ … The reviewing court considers only the ‘legal’ question ‘whether, after viewing the evidence in the light most favorable to the prosecution, any rational trier of fact could have found the essential elements of the crime beyond a reasonable doubt.’”

Given this standard, it is extremely rare for a court to grant a motion for acquittal, and there is little chance in Hunter Biden’s case that he will succeed in his motion.

What comes next?

After the prosecution calls its rebuttal witnesses, both sides will move to closing arguments.

The government lawyers took 30 minutes to make their opening statement Tuesday, while Lowell required 50.

Depending on when arguments wrap, the jury could get the case as soon as Monday afternoon and begin deliberating whether the president’s son broke the law.

Looks that way.  The Jury is probably too stoned to decide anything today.  Maybe a question to the Judge about where they can get good munchies?

Prosecution rests in Hunter Biden trial, closing arguments to being soon

After the prosecution rested its case, Judge Noreika told the jury she was going to read them some of the jury instructions.

She then told the jury after her partial jury instructions there will be a lunch break, and after lunch the court will move to closing arguments. Traditionally prosecution goes first, followed by defense followed by a final rebuttal from the prosecution if they choose to do so.

The jury will likely get the case this afternoon and begin deliberations either late today or first thing Tuesday morning.

Prosecution tees up alleged text message exchanges between Hunter and drug dealer

Hunter Biden defense attorney Abbe Lowell attempted to point to prior testimony about his client's location on October 15-16, 2018 in text message exchanges and that FBI Special Agent Erika Jensen didn't know exactly what he was doing at the 7-Elevens so early in the morning.

The prosecution in their line of questioning suggested that Hunter Biden was trying to reach out and find drug dealers as was a pattern in his messages before.

Moments after the prosecution had one additional question for her after Lowell finished and then said that they rest of their case, and no more rebuttal witnesses.

Justice Department prosecutor Derek Hines tried to establish that Hunter went to New York on Oct. 17-18, 2018, conflicting with Hunter's daughter Naomi Biden's testimony that he could have been in New York around Oct. 15.

Hines then pulled up Government Exhibit 125A, showing texts and location data from Hunter's messages and showed the timeline of texts/location data to the court:

    Text chain from 10/10/2018 shows Hunter arranging a meeting at 7-Eleven with someone (name of the person is unknown).
    Text chain from 10/11/2018 shows the same number texting Hunter that they are “at 7-Eleven.”
    Text from Hunter to Hallie on 10/13/2018 about “Bernard who hangs at 7-Eleven.”
    Geolocation data from 10/16/2018 put him near Hallie Biden's residence at 4 a.m.
    Location data shows Hunter in New York on 10/18/2018.
    Hines showed an email from Exhibit 19, pg 208 -- an excerpt from Hunter’s book -- about dealers not working on your time and arranging meetings at 7-Eleven.

The prosecution rested its case against Hunter Biden just after 11 A.M. Monday, while Biden never took the stand in his own defense.

Biden faces gun charges that arose from the 2018 purchase of a firearm, a purchase prosecutors allege was made while he as addicted to narcotics.

Prosecutor Leo Wise said the evidence in Hunter Biden's federal gun trial is “personal,” “ugly” and “overwhelming," but added that it is "necessary."

Hunter's own nonfiction book, "Beautiful Things," was "key evidence that Hunter was using drugs," Wise said, adding that his closing statements would focus on the evidence showing Hunter was addicted to drugs and “that he knew it."

Wise then displayed the firearm form on the screen (Exhibit 10a), pointed to question 11e which was highlighted, and said “this is the statement the evidence proved is false." The form Wise was referring to showed Biden checked a box which asked whether he was an illegal drug user before purchasing a firearm.

Regarding witnesses, Wise said Gordan Cleveland is the “only relevant” witness from the gun shop StarQuest Shooters, since he was the only person to testify he saw Hunter fill out the form.

Wise slowly walked through the elements in each count, highlighting that counts 1 and 2 are related to how the defendant acquired a gun by making a false statement, while count 3 is a possession offense. Wise added that there is no evidence that anyone else possessed the firearm.

Wise showed the courtroom a slide that defined the word “knowingly.” Wise then said that maybe if Hunter “hadn’t been to rehab” that he could argue he didn’t know he was an addict.

The prosecution's closing arguments are ongoing.

The jurors set to decide the fate of Hunter Biden might believe that the son of President Joe Biden is guilty of the three felony firearm offenses he faces in a historic federal gun trial – and still vote to acquit him.

Even if the prosecution ably proves its case surrounding Biden’s October 2018 purchase of a .38 revolver from a gun shop in Delaware – it’s alleged that Biden lied on ATF Form 4473 when he ticked a box labeled "No" that asked if he is an unlawful user of a firearm or addicted to controlled substances – the Biden family’s outsized influence in the state, the political leanings of jurors, or a dismissive attitude toward the charges brought could lead the jury to acquit.

"The Bidens’ influence and their power in the state can’t be underestimated," Heritage Foundation senior legal fellow Zack Smith told Fox News Digital. "But I think the sympathetic issue is the one that Hunter Biden’s legal team is focusing on."

Nearly all the jurors impaneled said during the selection process that they knew someone with substance abuse issues. Smith said it’s likely that Biden’s defense team is hoping to play on those sympathies to convince jurors not to hold Biden responsible for checking the box.

"Particularly, some of the jurors might have had family or friends struggling with substance abuse issues and have some sympathy for Hunter Biden and his substance abuse issues," Smith said.

Hunter Biden's defense team highlighted the high burden of proof the government has to meet in order to secure a guilty verdict, arguing that the prosecution has not met that high bar.

The defense accused the prosecution of using a "magicians trick," showing you part of the image in one hand but not giving you the full picture in the other.

They also talked issues with the timeline of events, accusing the defense of trying to connect issues of past behavior with the time of the gun purchase, noting that Biden's past behavior doesn't mean he was doing the same thing at the time of the purchase.

The defense also questioned the use of Biden's memoir, arguing that it's not a diary and it is what Biden remembers about being a drug addict.

In regards to the text messages sent around the time of the alleged gun purchase, the defense pointed out that Biden could have been lying about meeting a dealer or smoking crack, pointing to previous lies.

WILMINGTON, Del. — First son Hunter Biden had “lost the power of self-control” when he lied about his crack cocaine addiction to buy a gun in the fall of 2018, federal prosecutors told jurors in their closing argument Monday.

Prosecutor Leo Wise told the panelists in his summation that the government had proven a pattern of behavior by Hunter, now 54, that showed he was hooked on drugs beginning as far back as 2015 and continuing through at least 2019 — including through his own words to his loved ones.

 “We see in these messages [Hunter] buying drugs, telling other people he was using drugs, and describing himself as an addict,” Wise said. “He had lost the power of self-control. That’s why he kept going to rehab. He couldn’t stop on his own.”

The Biden scion is charged with three felony counts connected to his claim on a gun application form that he didn’t use illegal drugs the day he walked out of a Wilmington gun store with a .38-caliber Colt Cobra revolver.

Fox News contributor Jonathan Turley reacts to closing arguments in the first son's federal gun trial on 'America Reports.'

Turley argued that the defense's most effective argument against convicting Hunter Biden is actually where the case is taking place and jury nullification.

"This is Biden town. I think if you look at the defense, this is just as clear as you can get for a jury nullification case," Turley said.

Turley added that the arguments the defense put up "collapsed within the first 48 hours" of the trial, adding the the prosecution.

But Turley also noted those that were there to support Biden during the trial, which could make an impression on the jury.

"You have a sizeable Biden contingent in that courtroom reminding the jurors that this is Biden town, this is their hometown. And I think the prosecutors are worried that no matter how strong their case, they might not be able to overcome that," Turley said.

MSNBC analyst defends Hunter Biden in gun case by citing own alcoholism: 'Addiction is a disease'

MSNBC political analyst Molly Jong-Fast ran defense for Hunter Biden in a new column and TV appearance by calling addiction a "disease" and not a "moral failing" as his federal gun trial concludes this week.

"Addiction is a disease," she wrote on MSNBC. "People who struggle with addiction are sick, not bad. Huge swaths of the country are affected by alcohol and drug addiction that affects not just them, but their family members and people who are even tangentially connected to them — the parents, grandparents and kids and brothers and sisters and acquaintances of the addict."

"The reason why I wanted to come forward and write about this is because, even though I’ve been sober since I was a teenager, I felt that the disease that Hunter Biden has is the same disease that I have," Jong-Fast said Monday on "Morning Joe."

Hunter Biden arrives to Delaware court for day 7 of federal gun crime trial

Hunter Biden arrived to the Delaware courtroom for the seventh day of his federal gun crime trial Tuesday.

As with previous days, Hunter entered the court alongside his wife, Melissa Cohen.

Biden is facing charges of making a false statement in the purchase of a gun, making a false statement related to information required to be kept by a federally-licensed gun dealer and possession of a gun by a person who is an unlawful user of or addicted to a controlled substance.

The total maximum prison time for the three charges could be up to 25 years. Each count carries a maximum fine of $250,000 and three years of supervised release.
